Colorado Division of Reclamation, Mining, and Safety (DRMS) to alert him of the <br /> incident. Mr. Cunningham advised that he would alert Messrs. Travis Marshall and Dustin <br /> Czapla of the DRMS of the incident. Mr. Cunningham also provided the phone number to <br /> use to report the spill to the Colorado Department of Public Health and Environment <br /> (CDPHE). Following conversations with the DRMS, a call was placed to CDPHE, but <br /> CSQ personnel were unable to reach a person of authority or a mailbox that was not full. <br /> (As described in more detail below, CDPHE personnel were contacted by the DRMS and <br /> were again later contacted by HRL Compliance Solutions, Inc. on Wednesday, October 30, <br /> 2019.) <br /> On Thursday, October 17th, Mr. Mark P. Brewer of MSHA arrived at CSQ and assessed <br /> the nature of the previously mentioned hazard complaint. The resultant Mine <br /> Citation/Order #9028906 is included in Appendix C. <br /> Also on Thursday, October 171h, Clean Harbors, Inc. responded to the emergency spill call <br /> to assess the situation as the first emergency spill incident responder. A plan was <br /> developed between CSQ, GLA, and Clean Harbors representatives. This plan is detailed in <br /> the mitigation and remediation section of this report. CSQ returned all non-mitigation <br /> personnel to limited production activities on Thursday, October 171h. These limited <br /> production activities were to clear work in progress and to reach a safe shut-down state of <br /> the quarry. <br /> On Thursday, October 171h, an inspection hole was dug near the Franklin quarry surface <br /> opening along the marble outcrop (Figure 8). The hole was dug to the maximum depth the <br /> excavator could reach and was along the sloped marble bedrock surface. Placement was <br /> determined to visualize if dyed diesel was flowing along the fill to bedrock contact on the <br /> east side of the fill material. Excavation to the bedrock contact on the west side would <br /> have been near impossible due to constraints from blasted material and due to the dip of <br /> bedding. No stained soils or other evidence of diesel was observed during this digging <br /> exercise. CSQ operators began preparing clean-up activities at the sump. <br /> 14 <br />
