John Miner <br /> COAG Corporation <br /> 837 Eaglestone Drive <br /> Castle Rock CO. 80104 <br /> October 24,2019 <br /> Eric Scott <br /> Colorado DRMS <br /> RE: NOI File P-2007-069 <br /> Answers requested for the consideration of modification to NOI <br /> Recap. <br /> Wen we filed for the original NOI we had an option on the additional properties <br /> as well as the core properties where the NOI resides. <br /> As we proceeded with our Project the Seller got Balky due to a third party, resulting in <br /> a legal action to perfect our position. <br /> There were also Physical threats as well as other attempted intimidation. <br /> Seeking the correct remedies legal proceedings ensued. This was not anticipated. <br /> I could not ask any hired people to sort thru this kind of intimidation so with careful <br /> action and the Courts we proceeded resulting in long Delays. <br /> After we received judgement, the seller resorted to a last ditch effort in Bankruptcy <br /> Court resulting in another action. This is a persons Right by law and it takes how long it <br /> takes. I have no control over that time frame. <br /> The last hearing was in April of this Year with a decision expected in July of 2019, <br /> we are still waiting. <br /> Had we known this all would occur,,we would have waited to apply for the original NOI. <br /> To Date we have done extensive Metallurgical testing and Proof of process. Also we <br /> have improved the facilities and done extensive mine design. Our underground work <br /> determined that to safely access the 9 level we need to do extensive re-habilitation of <br /> the Franklin Shaft as well as the 6 level tunnel. <br /> We Expect a 1 year timeframe to complete the re timber of the Franklin Shaft. This is <br /> after a Six Month Campaign to initiate re commission of the Freighter Shaft. We could <br />
