The assessment included a desktop review and a field investigation. Species <br /> considered included the se listed by the U.S. Fish and Wildlife Service(USFWS)as threatened,endangered, <br /> proposed, or candidate State of Colorado as threatened, endangered, or species of special concern; and <br /> migratory birds. Specie activity data from Colorado Parks and Wildlife (CPW)was reviewed as part of the <br /> assessment. Results of I he desktop and field evaluations are summarized below. <br /> 3.1 Regula ions <br /> 3.1.1 Federal <br /> The Endangered Species Act (ESA) protects threatened and endangered species and their habitats and <br /> requires consultation with and concurrence by the USFWS for projects that have the potential to affect <br /> federally listed species.The ESA makes it unlawful to take a listed animal without a permit.Take is defined <br /> as, .....to harass, harm, oursue, hunt, shoot, wound, kill, trap, capture, or collect or attempt to engage in <br /> any such conduct." <br /> The Migratory Bird Treaty Act (MBTA) makes it illegal to take, possess, import, export, transport, sell, <br /> purchase, or offer fors le, any migratory bird, or the parts, nests, or eggs of such a bird except under the <br /> terms of a valid federal Dermit. Migratory bird species protected by the Act are listed in 50 CFR 10.13.The <br /> Bald and Golden Eagle Protection Act (BGEPA) provides additional protections for bald or golden eagles. <br /> 3 <br />
