G-14
anticipated contractual limitations. Each of these wells is a fully-permitted industrial water supply
well, owned and operated by Guttersen Ranches LLC or its assigns. CSC and/or Guttersen may
elect to utilize either or both of the two wells to provide this component of supply to the project.
Other (Currently Unidentified) Potential Source — CSC is also seeking additional water source
alternatives that may prove viable and feasible. The percent allocation from any such(currently)
unidentified source will be dependent on the potential combination of other sourcing option(s),but
likely would not exceed 70%of overall supply.
Irrespective of the selected water supply alternative, all process water will be purchased from a
third-party source(fully permitted and with adjudicated water rights appropriate for and consistent
with the proposed use)and imported to the site. Accordingly, all aspects of water usage associated
with the Keenesburg Project will be in compliance with applicable water laws and regulations.
(6) The Operator/Applicant shall affirmatively state that the Operator/Applicant has acquired(or
has applied for) a National Pollutant Discharge Elimination System (NPDES)permit from the
Water Quality Control Division at the Colorado Department of Public Health and Environment,
if necessary.
The Keenesburg No. 2 Mine operations will not result in any process water discharges. As such,
no NPDES (or the state-equivalent Colorado Discharge Permit System(CDPS) industrial process
water discharge permit)will be required, and none has been applied for.
The Keenesburg No. 2 Mine operations will, however,be subject to the requirements of a CDPS
General Stormwater Permit (COG500000) to manage all aspects of stormwater management in
conformance with the facility-specific Stormwater Management Plan(SWMP).
CSC has applied for coverage under the General Permit, with issuance pending. In addition,CSC
has, under the responsible charge of a Colorado-registered professional engineer, developed an
appropriate and facility-specific SWMP.
Keenesburg No. 2 Mine_112 Reclamation Operation—November 22, 2019
