Inspection Topic: Revegetation/Potential Noxious Weed Issue
The inspection report's evaluation of state-listed noxious weeds being present on-site has not been
adequately addressed with the quarry operator, specifically the location of areas of noxious weeds
within the permit area. Operator has requested a compliance assistance visit by Division to locate and
identify the areas of concern.
We have consulted with our expert, Mr. Fox regarding what is necessary for him to develop an action
plan for addressing this issue. His letter is attached.
If the noxious weed to which the inspection report refers to is"cheat grass," it is present in broad
swaths across much of the Western Slope, including Mesa County and areas both inside and outside of
the permit area, and inside and outside of areas which have been disturbed by mining. Operator deems
it unlikely that spot control of cheat grass will be an effective strategy; however, if there are particular
areas of concern, Mr. Fox will need more information to develop a potentially effective plan for
eradication or control. Once again, a compliance assistant visit has been requested to obtain specifics in
the development of a control plan.
As to the other noxious weeds, the operator welcomes a site inspection wherein Division can point to
specific areas needing further treatment for whichever specified noxious weed is indicated. Operator
has requested such an inspection; it is our understanding that Ms. Yeldell has recently gone on
maternity leave; we assume that Division will assign a responsible specialist in her absence.
Boundary Marking Topic: Boundary Markers
To try and foster a better geographic literacy, Rudy Fontanari has added more boundary markers to
those that were deemed to "abate" the last years' boundary questions, which we believed were put to
rest in October 2018. We have twice addressed the marker issue and have attached maps designating
the location of boundary markers. We have now further supplemented the markings, as follows.
Fontanari has posted the following markers, in addition to verifying that the prior markers remain in
place. Referrence is made to the points designated on maps provided to you just a few weeks ago:
ID# Lat Long Description
Al 39.1471 -108.3122 Along the northern boundary, west of point A
A2 39.1471 -108.3105 Along the northern boundary, east of point A
131 39.1435 -108.3116 Along the southern boundary of western leg, west of point B
62 39.1435 -108.3105 Along the southern boundary of western leg, east of point B
D1 39.1410 -108.3087 Along western side of the permit area, south of point D
D2 39.1403 -108.3087 Along western side of the permit area, south of D and D1
D3 39.1399 -108.3087 Along western side of permit area, south of D, D1, and D2
