TR Background <br /> Nix,M-2001-046 <br /> Page 2 <br /> The Current Land Use Proposal <br /> The Operator is working with a prospective tenant to develop water storage facilities on sand and <br /> gravel properties. Stage 2 is identified in an agreement between the Operator and this prospective <br /> tenant as the location of an "in-situ" reservoir. As you may be aware, the demand for water storage <br /> serving the Front Range of Colorado is substantial and the pace of excavation and conversion of <br /> former gravel pits will not keep pace with this demand in the foreseeable future; as a result, at Stage <br /> 2 a slurry wall will be installed and an in-situ reservoir operated without regard for the timing or <br /> completion of open-pit mining at the site. <br /> The Operator has recently consulted with Weld County, where the Nix property is permitted for <br /> mining as Use by Special Review# 1343. The annotation of Stage 2 in the USR-1343 Mine Plan, as a <br /> long-term reserve with no plan or permit for mining, is identical to the text presented in M-2001- <br /> 046. We reviewed with Weld County the plan for slurry wall installation in this area as a land use <br /> independent of the mining plan. Weld County has determined that this in-situ reservoir land use is <br /> distinct from mining uses and may therefore be permitted as an administrative amendment to the <br /> USR-1343 plans. <br /> The Operator is currently evaluating options for the Nix property as a whole and expects that mining- <br /> specific adjustments to mining and reclamation plans may be appropriate. However, the installation <br /> of a slurry wall in Stage 2 in no way conflicts with existing permits. While it remains a long-term <br /> gravel reserve, for example, farm use is expected to continue on the land surface within Stage 2. <br /> Please find enclosed the relevant TR request. This TR is intended to provide notice of the proposed <br /> use at Stage 2 in conjunction with the Weld County USR amendment process.
