S <br /> V <br /> D <br /> ETE COMPANY <br /> 14 October 2019 <br /> Eric Scott, Division of Reclamation, Mining and Safety <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 <br /> Re: Background on Submittal of TR request, Nix Sand and Gravel Mine, M-2001-046 <br /> Mr. Scott: <br /> This letter concerns planned uses other than commercial mining and reclamation on land within the <br /> permit area of the Nix Sand and Gravel Mine (M-2001-046), located in Section 28, Township 3 North, <br /> Range 67 West, near Platteville, Colorado. As the Operator, Ready Mixed Concrete Company, we are <br /> prepared to allow a tenant to install a slurry wall for non-mining purposes within an area of the <br /> permitted site. <br /> You will find under this cover letter additional technical materials, including a requested Technical <br /> Revision (TR). This letter provides relevant background and analysis, particularly relating to the <br /> Operator's expectation that the current slurry wall project has little to no effect on the status or <br /> bonding of the M-2001-046 permit. <br /> Background—Stage 2 <br /> The subject portion of the property is referred to as "Stage 2" in original permit documents. This <br /> portion of the overall Nix permit area consists of most of the northeast quarter of Section 28. Stage <br /> 2 is approximately 149.6 of 307.2 total acres permitted under M-2001-046. Please refer to the <br /> attached copy of Exhibit C-3 (Mine Plan Map). <br /> According to the current permit, Stage 2 is not the subject of any specific mining or reclamation plan. <br /> The Mine Plan Map submitted and approved by both the state and Weld County denotes the <br /> following for this area in large, bold text: "Stage 2 Mine area long-term future reserves included in <br /> permit boundary but not planned and permitted in this application. Permits to be amended with <br /> details in the future. Current and interim use to remain as active farm land." <br /> As currently permitted, the DRMS and MLRB hold a $317,000 bond for agricultural/rangeland <br /> reclamation relating to areas of the permitted site other than Stage 2. Correspondence during the <br /> adequacy review process in 2002 indicates the bond covers stockpile mobilization and re-grading of <br /> the largest potential area of pit abandonment in the numbered, southern pit areas denoted on <br /> Exhibit C-3. <br /> Ready Mixed Concrete Company Address: 11778 Highway 52,Fort Lupton,Colorado 80621 Office Phone: (303)286-1983 <br />
