MINING PLAN (CONT) EXHIBIT D <br /> September 2019 <br /> (i) One of the primary reasons to amend this 112 operation is <br /> to enlarge the minable land available in the permit area so no <br /> ground water will be encountered. Surface water will not be <br /> intercepted or disturbed but will flow uninterrupted downstream <br /> as it has done historically. Mining will not affect the quan- <br /> tity or quality of the surface or groundwater systems . There <br /> will be no proposed dewatering, sediment containment, chemical <br /> treatment systems, storm water run-off controls, of groundwater <br /> points of compliance . No ground water will be encountered on <br /> the upland areas . <br /> (j ) Colorado water laws and regulations governing injury to <br /> existing water rights will be complied with. By not using any <br /> water in this operation that is not approved, we mean no evapo- <br /> ration from impoundments or diversions, nor from exposed ground <br /> water areas will be on the mine . <br /> (k) No refuse, acid or toxic producing materials are created <br /> during mining of this sand body or the upland terrace deposits . <br /> (1) As explained earlier this will be a dry pit operation which <br /> by its nature eliminates any disturbance to the hydrologic <br /> balance . There will no activities to cause off-site damage . A <br /> stable configuration of the reclaimed area will be part of this <br /> operation as the end product will be a dry arroyo. The upland <br /> areas that are not reclaimed by flooding will be graded, <br /> recoiled and seeded with the approved seed mix. <br /> (m) In most cases, the sand deposit will not be processed <br /> on-site . Processing will take place at various off-site areas <br /> approved for that activity. The upland material will require <br /> some processing by screening, but no chemicals will be used. <br /> (n) The primary commodities to be mined/extracted are limited <br /> to sand and a small amount -6" rock. It will be used only for <br /> construction aggregates or road base materials and fill . No <br /> secondary products will be produced. <br /> (o) As stated above there are no incidental products to be <br /> involved in the mining/extraction by this operation. <br /> 10 <br />
