OSMRE <br /> agrees with the proposed decision and hereby provides concurrence in accordance with 30 CFR 70.15 <br /> (d)(3) and 30 CFR 90 . , Article IX, Section 24 of the State-Federal Cooperative Agreement. <br /> The surface and mineral ownership associated with this bond release is a combination of private., state, <br /> and federal. The Bureau of Land Management(BUNT) was notified of the inspection by letter dated June <br /> 11 2018,but was unable to attend. DFB participated in the SL--11 bond release inspection conducted on <br /> June 27, 2018. Neither BUNT or OSMRB participated in DRMS's subsequent follow-up inspections. By <br /> letter dated October 10, 2019,BLM provided its concurrence with DRMS's proposed decision. <br /> DRMS's proposed decision notes Snowcap's compliance with the approved Colorado regulatory <br /> program at Rules .0 .1 2b and .o .l 2c and recommends authorizing partial Phase II and III <br /> bond release on 2.4 acres and III bond release on 8 reclaimed acres as well as 291.3 acres which were <br /> undermined but not disturbed on the surface by mining activities at the roadside Portals Mne. DRMS <br /> currently bolds a performance bond in the amount of$65,702.24 which covers the entire permit area, <br /> including the acreage proposed for release. Under SL-11, l RMS proposes to release a total of <br /> $10,089.00 from Phase II 2.4 acres) and III 01.7 acres)bond liability. DFB concurs with DRMS's <br /> proposed decision and recommends Phase H and II1 bond release for the requested areas at the Roadside <br /> Portals Mine. <br /> Thank you and your staff for coordinating this bond release action through DFB.
