Black Mountain has sent a notice <br /> to further parties identified in Attachment 1. Proof of notice and delivery will be provided to the division as <br /> soon as it is available.To clarify, Colorado Interstate Gas Co. holds a lease for a communication tower on <br /> neighboring state land in Section 15.That tower is located 45 feet from Black Mountain's project boundary <br /> and an additional 247 feet from the nearest affected lands boundary, a total of 292 feet from Black <br /> Mountain's affected land boundary so notification is not required.There are also three additional <br /> communication towers, presumably with their own easements or leases, located on the State of Colorado <br /> lands within section 15.All three towers are located more than 200 feet from the affected lands boundary. <br /> Black Mountain did provide a notification to the landowner,the State of Colorado in which is the <br /> Grantor/Lessor for such easements/leases. <br /> Black Mountain previously submitted additional receipts of certified mailing for stakeholders not included <br /> on the surface landowner list.An explanation of these discrepancies is included below: <br /> • American Tower Asset Sub LLC—as explained above, American Tower holds the easement for a <br /> communication tower located within the minimum 200-foot buffer zone of Black Mountain's project in <br /> Section 14.As noted in Addendum S of Black Mountain's application, Black Mountain and American <br /> Tower are in the process of completing a permanent easement at the site for these easement areas.The <br /> existing easement held by American Tower has been marked on Exhibit C1 and Exhibit C2,as requested <br /> by the division. Modified maps are included in Attachment 2. <br /> • John S. Painter—Mr. Painter is listed in the Weld County records as a mineral owner for all or portions of <br /> section 3, 10, 11, and 14. <br /> • John Yocam—Mr.Yocam owns land in Section 15 south and west of the property. He owns land as part <br /> of the Yocam Family Limited Partnership LLLP,which was notified separately, and also in his own name <br /> in Section 15 adjacent to and kiddie-corner to Black Mountain Land Company, LP's land holdings in <br /> Section 14. <br /> • Lost Creek Land &Cattle Co.—Lost Creek Land &Cattle Co.are the former owners of the property <br /> currently proposed for use in the mining application.They were added as a courtesy as they requested <br /> to be kept informed of proposed changed for the lands. <br /> • Cauctus Energy of Colorado—Cauctus Energy of Colorado is listed as the current owner of one of the <br /> plugged oil and gas wells located onsite (Charles Brown#1).Their notification letter was returned as <br /> undeliverable, as shown in Attachment 1. Details of the oil&gas well in question are provided under <br /> Item 12 and in Attachment 4. <br /> • Continental Oil Company—Continental Oil Company is listed as the current owner of one of the plugged <br /> oil &gas wells located onsite (Prospect-Royalty#1). Details of the oil &gas well in question are provided <br /> under Item 12 and in Attachment 4. <br />
