Amended Aggregate Industries South Platte Combined SWSP August 27, 2019 <br /> Plan I Ds 3614, 47731 3624, 47721 4616, 3437, 3376, 3650, 3668, and 5475 Page 17 of 21 <br /> purposes of this SWSP, this affidavit will be accepted for the dedication of the shares; <br /> however, if the State Engineer determines that a different affidavit or dedication process is <br /> necessary to assure proper dedication of the shares, additional information may be required <br /> prior to future SWSP approvals. <br /> 10. All diversions shall be measured in a manner acceptable to the division engineer. The <br /> Applicant shall install and have approved by the Water Commissioner all structures prior to <br /> any credit or use in this SWSP. Applicant shall maintain such measuring devices as required <br /> by the division engineer for operation of this SWSP. In addition, the applicant shall maintain <br /> daily records of all diversions, replacements, and the amount of water used for each <br /> particular purpose. The applicant shall provide a report of these records to the division <br /> engineer and the water commissioner on a monthly basis, or more frequent as required, on a <br /> form approved by them. The accounting must be submitted to the division engineer in <br /> Greeley (DNR Div1Accountine@state.co.us) and the water commissioners [Jorge Vidal <br /> (Jorge.Vida[@state.co.us), Mark Simpson (Mark.Simpson@state.co.us), Shera Sumerford <br /> (Shera.Sumerford@ state.co.us), and Bob Carlson (Bob.Carlson @ state.co.us)] within 30 <br /> calendar days of the end of the month for which the accounting is being made. Submitted <br /> accounting shall conform to the Administration Protocol "Augmentation Plan Accounting, <br /> Division One - South Platte River" (attached). <br /> In addition, the applicant shall verify that each entity making replacements for this plan, <br /> have included this plan in their respective accounting submitted to the division engineer. For <br /> this plan period those entities are the Centennial Water and Sanitation District, City of <br /> Westminster, and City of Thornton. <br /> 11. The installation of any device used for measuring replacement water in this plan must be <br /> inspected by a Division 1 hydrographer. Furthermore, the exact location of all return <br /> structures utilized in this plan must be provided to the division engineer and appropriate <br /> water commissioner in order to allow for inspections of the structures. Finally, all charts or <br /> other output data associated with each measuring device utilized in this plan must be <br /> provided in a timely manner acceptable to all of the water commissioners identified herein. <br /> 12. The Applicant shall be required to notify and obtain approval of the Water Commissioners in <br /> writing a minimum of 48 hours, or as required by each individual Water Commissioner, of all <br /> planned releases and exchanges, including but not limited to, location, amount, and timing <br /> (start and end dates). <br /> 13. The Division Engineer, or his designated representative, will administer all such water <br /> transported in the South Platte River or its tributaries under this SWSP, including water for <br /> replacement of depletions, past intervening headgates to ensure that such water is not <br /> intercepted or otherwise diminished in quantity by diversion, use or other interference by <br /> intervening water rights and to assure that such water remains available and suitable for <br /> Applicant's uses under this SWSP, except when any intervening headgate is diverting the <br /> entire flow of ("sweeping") the river. In the event that delivery past headgates which sweep <br /> the river requires the installation of a bypass structure or the use of an existing bypass <br /> structure by agreement with a third-party, Applicant is responsible for either installing a new <br /> bypass structure with a continuous recording measuring device(s) as approved by the Water <br /> Commissioner or securing an agreement with a third-party to use an existing bypass structure <br /> and providing such information and agreement to the Division Engineer. <br /> 14. The Division of Water Resources will not be responsible for any enforcement or administration <br /> of third party agreements that are not included in a decree of the water court. <br />
