L.G. Everist Combined SWSP Page 8 of 16 <br /> March 14, 2018 <br /> As part of the SWSP you have also requested approval to allow L.G. Everit to use its changed <br /> Rural Ditch water for uses associated with the mining operations at the Carbon Valley Pit and Firestone <br /> Pit since the sites are close to one another on the south side of the Saint Vrain Creek. The shares would <br /> be used directly at these two sites for uses associated with the mining operations. <br /> We have reviewed your request and determined that since the Rural Ditch water dedicated to <br /> this SWSP was changed as part of the combined plan such water can potentially be used at the Carbon <br /> Valley Pit and Firestone Pit for uses associated with the mining operations at these sites, provided <br /> return flow obligation for the delivery of the Rural Ditch water are maintained by the combined plan, <br /> and the use of the Rural Ditch water for augmentation and direct use for mining operations uses is <br /> properly accounted for. In addition L.G. Everist needs to demonstrate that sufficient replacement water <br /> sources are available to replace depletions at the Rinn Valley Pit, Carbon Valley Pit and Firestone Pit <br /> sites. The approval to use the Rural Ditch water for mining operations uses at Carbon Valley Pit and <br /> Firestone Pit is for the 2018 and 2019 irrigation season. Diversion of the Rural Ditch water for mining <br /> operation uses at Carbon Valley Pit and Firestone Pit is limited to the historical average diversions and <br /> return flows must be calculated using the return flow factors listed in Table G above. <br /> Excess credits generated at the Fort Lupton permit area on the South Platte River may be <br /> available for use at Saint Vrain sites (Carbon Valley Pit, Rinn Valley Pit and Firestone Pit). Any credits <br /> from the Fort Lupton site to be used at the St Vrain site will only occur during periods without an <br /> intervening call (the potential calling right is the Western Mutual Ditch) and will account for transit <br /> losses for the approximately 15 river miles between the Fort Lupton site and the St Vrain Creek <br /> confluence with the South Platte River. Transit losses will be 0.50 percent per mile summer transit loss <br /> and 0.25 percent per mile winter transit loss. The transit loss percentages are subject to change <br /> depending upon current conditions. If transit losses change they will be communicated by the Division <br /> Engineer via email to the Division One Call List. The applicant shall obtain prior permission from the <br /> District 2 and 5 Water Commissioners when making releases from storage on the Fort Lupton site. Credit <br /> will not be given to any releases not measured and recorded to the satisfaction of the District 2 and 5 <br /> Water Commissioners or Division Engineer. <br /> South Platte River <br /> L. G. Everist owns 2.25 shares of the Lupton Bottom Ditch. Of the 2.25 shares of the Lupton <br /> Bottom Ditch water, 1 share will be dedicated to this plan in 2018 and 2019. The 2.25 shares were <br /> historically used to irrigate 95 acres of corn and small vegetables. The land historically irrigated by the <br /> 2.25 shares is the same land that is currently being mined at the Ft. Lupton Sand and Gravel Pit. <br /> Assuming a 10% ditch loss and a 55% irrigation efficiency, the dry-year consumptive use of the 2.25 <br /> shares was determined to be 138 acre-feet. The dry years considered in this analysis are the 1954, <br /> 1977, 1978 and 2002.
