Please inform the Division if these notifications been sent and if documentation is <br /> available for review. Example letter was provided to the Division on 2/28/2019, but it <br /> is unclear if these letters have been sent out to appropriate parties. <br /> b. Please ensure the surface/subsurface ownership information and maps have been <br /> reviewed and updated. Updated information was provided to the Division received <br /> 2/28/2019. However as the LBM has not yet been approved,this may need to be re <br /> addressed once approval has been received as changes may occur during the <br /> extension. <br /> 5. The Division understands that TC is pursuing leasing the Federal coal with a Lease By <br /> Modification (LBM)for the inclusion of the Wolf Creek Seam in the Federal Coal Lease COC- <br /> 54608. Per Rule 2.03.6 Right of Entry,the Division cannot approve a mine plan that includes <br /> mining in the Wolf Creek Seam within this area until the LBM has been approved. Should the <br /> LBM not be approved by the time all other PR-12 adequacy issues have been resolved, TC will <br /> have to request continued extension of the decision due date until the LBM is approved. LBM <br /> has not been approved. <br /> 6. The proposed revised text(p.2.04.11) does not appear to line up with currently approved pages <br /> and appears to be missing information necessary for the review of PR12. Please provide <br /> updates to the section WOLF CREEK RESERVES including: <br /> a. The updated status of the pooled water, <br /> b. The updated plan to manage the pooled water, including any updates to relevant <br /> exhibits. <br /> c. Updated text relative to MSHA approval to undermine the PR12 proposed panels, <br /> including if that approval is for development, long wall, and/or retreat mining, as well as <br /> any exhibits that may need to be updated or submitted to provide this documentation. <br /> The revised text submitted by the operator in the February 2019 response does not <br /> adequately address how dewatering will be accomplished or where that water will be stored. <br /> The operator has referenced TR-84,which has been approved by the Division, but this is <br /> approved as a non-discharging system. Please provide the details of how the water above the <br /> relevant panels will be handled or revise the scale of this PR to only include mining of panels <br /> that do not require dewatering and submit the additional areas under a future revision. <br /> 7. The proposed revised text(p.2.05-181.11) includes a new exhibit, Exhibit 7K, addressing an <br /> inventory of structures and renewable resource lands. This exhibit was not included with the <br /> PR-12 application. Please provide the Division with Exhibit 7K for further evaluation of <br /> adequacy. Exhibit 7k was provided and reviewed with the PR10 and PR11 submittals. <br />
