July 9, 2019 C-1981-041/Roadside Portals CCW <br /> DWR(represented by Ben Krause and Alan Martellaro). Mr. Fontanari's gravel pits and ditches were observed as <br /> a part of this partial inspection and Amy Yeldell conducted a Minerals Regulatory inspection in association with <br /> M-1996-076. Seeps located on the northern edge of the Tract 70 mesa were also observed. DWR, Snowcap and <br /> the Division observed water from Mr. Fontanari's ditches flowing into the holes labeled Object ID 86, 87, and 88. <br /> These were the same ditches that were observed to be flowing earlier in the day. During the inspection, surface <br /> flow from the furthest north ditch flowing north towards the edge of the mesa was observed. The water stopped <br /> approximatly 10 feet from the edge of the mesa and was seeping into the ground Photo(10). These observeations <br /> were also noted by DWR personnel during the Division's inspection. The Division of Water Resources' <br /> representatives stated to the Division and Snowcap that the water flowing into Object IDs 87 and 88 was not an <br /> acceptable use of his water right. DWR also expressed concern about the water flowing to the edge of the mesa <br /> and the seeps on the north side of the mesa. DWR stated to the Division and Snowcap that they would be <br /> contacting the Colorado Department of Transportation(CDOT)to infom them of the observations at the site. <br /> July 11, 2019: <br /> On the morning of July 11 I received a phone call from Tonya Hammond informing me that CDOT had closed the <br /> left lane of east bound I-70 due to rockfall. The location of I-70 closed by CDOT was the same area directly <br /> below the seeps observed on July 9. A site visit to document the conditions at the seeps and the conditions on top <br /> of the Tract 70 mesa was conducted on July 11. The seeps on the north face of the mesa were observed to be <br /> flowing. Once on top of the mesa, Tonya Hammond and I noticed another vehicle driving south on the Tract 70 <br /> access road. The vehicle stopped by one of the diversions of Mr. Fontanari's pipeline into a ditch. I observed Mr. <br /> Beckwith get out of his vehicle and walk over to the pipeline diversion to the ditch. Tonya and I pulled over our <br /> vehicle to get out and talk with Mr. Beckwith. At this time Mr. Fontanari drove up in his vehicle. Mr. Beckwith <br /> asked me what the purpose of the visit to the site was. I informed him I was there to document the conditions at <br /> the mine site. Mr. Beckwith asked if I had observed a crack at the north end of the mesa. I told him I was not <br /> aware of the feature and he offered to show Ms. Hammond and I where it was. This feature was documented as <br /> Line Object 10. <br /> Once Mr. Beckwith showed me the new crack he continued to walk to a point on the edge of the mesa where he <br /> scaled down the slope to take photos of the seeps. Due to the unstable nature of the slope, I did not venture down <br /> the slope. I documented the seeps from a location several paces to the east on top of the mesa. The ditches on the <br /> north end of Tract 70 that were observed to be flowing on July 9 were not flowing at the time of the inspection on <br /> July 11. Although the ditches were not flowing,they were observed to be wet, indicating that they had been <br /> flowing recently. Soils in the northern area of the mesa remained saturated and were soft. On I-70 below the <br /> mesa,the southern eastbound lane was closed and CDOT vehicles and personel were seen. <br /> The partial inspection then continued to the south in the vicinity of Snowcap's replred Object IDs 54, 55, and 56. I <br /> asked Mr. Beckwith for clairification of the location of a crack brought to the Division's attention in a email from <br /> David Fox(dated June 24, 2019). Mr. Beckwith showed me the general location of the crack. I asked Mr. <br /> Beckwith the extent that he thought the crack extended to. Mr. Beckwith replied it went from where I was <br /> currently standing at the time, extending west accross the access road. Mr. Beckwith was with Mr. Fontanari at <br /> the location of Object IDs 87 and 88 documenting their demensions with a measuring tape.
