Your property is zoned <br /> Agricultural Estate (AE). In 2014,the Archuleta Board of County Commissioners approved a <br /> Conditional Use Permit(CUP)on the property for"for the underground storage building to <br /> mitigate mining" with conditions. <br /> In response to complaints received from neighbors, on 22 June 2018, 1 issued a Notice of <br /> Violation of the terms of that CUP. (Reference case file ENF18-00004.) On 3 July 2018, 1 <br /> received a copy of a survey,at which time we noted proposed retaining walls required building <br /> permit subject to setback Variance (25'from property line). We met last on 8 October 2018 to <br /> discuss options for your project. <br /> The proposed revisions show a Realigned driveway(25-ft wide)aligned with the existing access <br /> perpendicular to the road,with the current driveway from the road to receive 2:1 slope backfill <br /> (with notes on reclamation of areas previously subject to neighbors' complaints). As long as any <br /> retaining walls or other structures subject to setbacks remain more than 25'from the adjacent <br /> property lines,we could consider this proposal with a Land Use Permit application for a Minor <br /> Amendment of your Conditional Use Permit.
