These ditches are located within the affected area; <br /> however, mining will not occur within any of these ditches as the limits of mining excavation is <br /> located outside these ditches. Aggregate Industries will obtain a Colorado Discharge Permit <br /> System (CDPS) Permit COG500000 and will discharge groundwater into the Brighton Return as <br /> part of dewatering operations for the site in accordance with COG500000. Al will comply with <br /> any monitoring and mitigation measures required for this permit. Impacts to the Plains Minnow, <br /> Suckermouth Minnow and Brassy Minnow are not expected. <br /> b. Please update Table 10 to indicate the fish species of concern will be monitored for and/or <br /> otherwise protected with the measures to be designed. As the un-named tributary is planned to <br /> be mined, this table incorrectly states this area will be avoided. <br /> Please see comment 25a. <br /> c. Prior to affecting this area, the Operator will need to conduct a survey to ascertain if species of <br /> Brassy Minnow, Plains Minnow and/or Suckermouth Minnow exist within the unnamed tributary. <br /> Please place a buffer zone around this tributary and commit to conducting a survey of the <br /> tributary prior to affecting land within the buffer zone. <br /> Please see comment 25a. In accordance with comment 28a, a buffer zone has been placed <br /> around all wetlands and other potential WOTUS (delineated features)within the mining <br /> excavation limits on Exhibits C2 through C5. Aggregate Industries will receive approval from <br /> the USACE prior to impacting area within the buffer zone. <br /> Although there is potential for the Brassy Minnow, Plains Minnow and/or Suckermouth <br /> Minnow to occur within the Brighton Return, impacts to these species are not expected. As <br /> such, Aggregate Industries does not plan to conduct surveys of the Brighton Return. <br /> d. Please update the Exhibit C-5 map to depict this buffer zone and add a section to Exhibit H that <br /> discusses the monitoring and potential mitigation measures that will be taken should these <br /> species be found during the pre-mining survey. The Division strongly encourages the Applicant <br /> to contact Colorado Parks and Wildlife when preparing the buffer zone, pre-mine survey and <br /> any potential mitigation measures. <br /> Please see comment 25a.
