Letter, 24 June 2019 M2013-066 Loblolly Pit Page 2 <br /> Exhibit G —Water Information <br /> During mining: Initially, in the South Parcel, the pit was dewatered and water pumped back into <br /> the river, but this has not been done in the North Parcel. All dewatering and discharge of water <br /> into Waters of the State has ceased and there is no plan to again do so. There is presently no <br /> surface discharge of water from affected areas of the site, and there is adequate storage <br /> capacity in the ponds/basins to accept runoff from adjacent, unaffected land without any surface <br /> discharge for at least a 100-year, 24-hour storm event. <br /> During reclamation and post-reclamation: The water level in the ponds on both parcels will rise <br /> and fall with the water flow in the river, and there will therefore be an area around each pond in <br /> which changing water levels may result in both quantities and species of grass and forbs which <br /> flourish best, and in which willows and other water-tolerant species will naturally become <br /> established. <br /> Exhibit J Vegetation (including Seed Mix) <br /> The seed mixes in Exhibit J, Item 3 currently remain unchanged. This additional information is <br /> provided as requested: <br /> Seed mix #1 (temporary) will continue to be used to stabilize soil stockpiles and other areas in <br /> order to prevent/mitigate wind and water erosion, protect soil and other purposes, including the <br /> 4.6 acre areas which are industrial sites. <br /> Seed mix#2 (irrigated/semi-irrigated) will be used adjacent to the ponds and in general, east of <br /> the pipeline which divides both parcels. The initial seeding of the South Parcel areas now at <br /> final grade with soil (12.7 acres of the large area around the ponds), uses the irrigated/semi- <br /> irrigated mix. <br /> Seed mix #3 (grazing) will be used generally west of the pipeline and in areas higher in <br /> elevation than the immediate vicinity of the ponds, and adjacent to the permanent roads. <br /> If done while this permit is still active, any reclamation of the well pads in both parcels will be <br /> done in accordance with COGCC requirements in affect at the time of reclamation of those pads <br /> and the associated disturbed areas. The reclamation plan continues to assume that the roads to <br /> these pads will be permanent, as access to the reclaimed well pads will still be necessary. <br /> I <br /> The exact locations for use of the various seed mixes cannot be accurately determined until <br /> final reclamation and upon advice (and site visits) from NRCS/Conservation District gurus to <br /> examine soil and moisture conditions. We also need to keep in mind that NRCS may change <br /> recommendations as to the best seed mixes. Therefore, the TR again emphasizes that the seed <br /> mix used at the time of final reclamation may change based on NRCS/NRCD recommendations <br /> to the landowner. <br /> Exhibit L Reclamation Cost Estimate <br /> As regarding reclamation and cost estimating of the performance warranty: <br /> 1. Although the surface has been disturbed west of the Pipeline in both the North and South <br /> Parcels, there has been no actual excavation of materials in those areas yet. That mining, when <br /> done in the future, will require again estimating cost of reclamation at that time. <br /> 2. Since the 2019 Annual Report and the 2019 Inspection, the stockpiles and the berm along <br /> the road near the bridge (in the South Parcel) have been removed. (The new 2019 Annual <br /> Report maps show the status as of April-May of 2019 and your visit.) <br /> 3. The South Parcel is zoned industrial, and in addition to the three areas identified as industrial <br /> sites at present, there would certainly be others in the future. However, for purposes of <br /> reclamation cost estimates, it is reasonable to assume for now that all of those would have <br /> topsoil replaced and be seeded to grass. <br /> 4. As part of the TR, it is important to again note that the South Parcel may be hosting various <br /> temporary or permanent industrial plants/activities (including but not limited to ready-mixed <br /> concrete plants, hot-mix asphalt facilities, sawmills, grinding and shredding, and other <br />
