Mr. Cliff chiles of ERMR accompanied the
inspection. The New Horizon North Mine is a reclaimed surface mine. No facilities or personnel remain on the
New Horizon North site. ERMR personnel are located at the sister mine, New Horizon Mine. Records are stored
at the New Horizon Mine office as well.

The area weather has been unusually cool and wet. The weather the day of the inspection was clear, though light
clouds moved in as the day progressed. The ground was soft but not muddy.

AVAILABILITY OF RECORDS – Rule 5.02.4(1):
Mine records are stored at the New Horizon mine office. Records were checked and the “Availability of
Records” form is included with this report.

FISH and WILDLIFE – Rule 4.18:
A red fox was observed on the Bench 1 stockpile on the north east side of Pond 001.

HYDROLOGIC BALANCE - Rule 4.05
Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10;
Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13;
Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18:
Two sediment ponds remain on the permit area, Pond 001 and Pond 002.

Pond 001 is located at the southern extent of the permit area. Pond 001 was holding a very shallow pool of water.
This pool is many feet below the discharge elevation. There was no evidence that the water elevation had
previously approached the discharge elevation. Recently graded inslopes appear stable and are not eroding.
Seeded grasses on the regraded inslope to the pond were beginning to emerge and become established. No
concerns were noted with this pond.
