4 <br /> BLACK MOUNTAIN SAND <br /> 420 Commerce St. Suite 500, Fort Worth,TX 76102 <br /> (817) 698-9901 <br /> • U.S. Army Corps of Engineers—Commenter <br /> • A statement that project is not within Corps owned or operated lands so they recommend <br /> plan be submitted to local floodplain administrator for review&approval prior to <br /> construction— Black Mountain has already met with Weld County's personnel who have <br /> verified the project is not within the local floodplain and therefore does not require any <br /> additional review. <br /> • A statement urging verification of compliance with both Weld County&State floodplain <br /> management criteria—Black Mountain has already met with Weld County's personnel <br /> who have verified the project is not within the local floodplain and therefore does not <br /> require any additional review. <br /> • History Colorado—Commenter <br /> • A statement that no cultural resources inventories have been recorded for the site and no <br /> historical properties have been recorded and therefore no data is available for them to <br /> comment on—Because the project is on private land, a cultural resources inventory is not <br /> required. However, a tabletop cultural resources inventory of the project area was <br /> completed and no cultural resources or historical properties were identified at the site. <br /> Historical use of the area is well documented and no significant features intersect the <br /> project area. Black Mountain will comply with all federal, state, and local laws with <br /> respect to the discovery of both cultural resources and human remains during operations. <br /> • West Greeley Conservation District—Commenter <br /> • A statement that they were not formally notified of this project; they were informed by <br /> various land owners and the neighboring Ft. Morgan Conservation District— Notification <br /> of conservation districts is required as part of the Weld County Use by Special Review <br /> process if the project boundary is within a conservation district. The Lost Creek project is <br /> not located within any conservation district, but does border two districts: West Greeley <br /> and Southeast Weld. Although notification of the conservation districts is not required by <br /> the state application process, Black Mountain will add the West Greeley Conservation <br /> District to its list for future project notifications. <br /> • A statement that they would like to be part of the USR review—the Use by Special Review <br /> (USR) is the Weld County land use application process. Black Mountain has not yet <br /> submitted a USR application to Weld County.After Black Mountain submits an <br /> amendment to the state application,the USR application for Weld County will be finalized <br /> and submitted. A timeline for the Weld County application submittal is not currently <br /> known. <br /> • A statement that they are concerned for the surrounding land owners and agencies this <br /> project may impact and the effects the project may have from a conservation standpoint, <br /> including traffic, dust, and water quality— Black Mountain has been in contact with several <br /> local land owners and nearby entities, as well as local agencies to discuss the project and <br /> potential impacts. Multiple water quality tests were conducted and additional data is <br /> being added to the pending CDRMS application amendment regarding the potential <br /> impacts to water quality from the proposed mining activities. While traffic and dust <br /> concerns are not part of the scope of the state application review,they will be discussed <br />
