As you are aware, Black <br /> Mountain has been in communication with several of the commenters as part of our public outreach <br /> program for this project and we have modified our proposed mining and reclamation plans based on <br /> public feedback. Black Mountain is in the process of drafting a mine permit application amendment, which <br /> will address these comments and objections as well as other public feedback we have received. <br /> During the public comment period, which was open from March 25— May 9, 2019, four comment letters <br /> and 3 objection letters were received by CDRMS for the Lost Creek project. A summary of those <br /> comments/objections and Black Mountain's response is included below: <br /> • Colorado Division of Water—Commenter <br /> o A statement that since the operation does not anticipate exposing groundwater, exposure <br /> must not occur&the operation must stay at least 2 feet above the water table <br /> throughout operations—Black Mountain's mine plan has been designed to stay at least 2 <br /> feet above the known water table within each phase of the mine plan. <br /> o A statement that applicant must identify specific well permits or water rights that will <br /> provide water for the project & provide evidence that water is approved for the proposed <br /> use— Black Mountain proposes to use water from existing wells on lands owned by Black <br /> Mountain to the west of the proposed Lost Creek project boundary. Black Mountain is <br /> currently in the process of converting the use of water rights from those wells to multiple <br /> use and will provide additional data, such as the well permit numbers and location, in the <br /> application amendment. If proof of multiple use is available at the time of amendment, <br /> such proof will also be provided, otherwise proof will be provided as soon as it is available. <br /> o A statement that any stormwater runoff captured by the operation must be released back <br /> into the stream system within 72 hours and may require a discharge permit— Black <br /> Mountain's stormwater designs for both construction and operations have taken into <br /> account this requirement. However, Black Mountain will add a clear statement stating as <br /> such in the application amendment. <br />
