B-21 <br /> threatened, endangered, or species of special concern, and migratory birds. Species activity data from <br /> Colorado Parks and Wildlife (CPW)was also reviewed as part of the assessment. <br /> The habitat provided by the area is that of grasslands habitat, with gently rolling topography. Vegetation <br /> is composed of various grasses, yucca, and sand sagebrush. Trees are absent from the Permit Area and <br /> immediate surrounds;however,areas of ponded water,dense vegetation,trees,and adjacent wetland habitat <br /> are present within Ennis Draw,approximately one mile east of the Permit Area. Elevation within the Permit <br /> Area ranges from approximately 4,912 ft. to 4,893 ft. amsl, thereafter descending to approximately 4,800 <br /> ft. amsl along Ennis Draw (to the east). The average annual precipitation is 14.67 inches. In general, the <br /> Permit Area(and surrounding area)exhibits a relatively homogeneous landscape,with the exception of the <br /> Ennis Draw feature. <br /> Federal Species: A total of eight Federally-listed species were identified as having the potential to occur <br /> within the Project area or that have the potential to be affected by the proposed Project. These include: (a) <br /> the Least Tern, Mexican Spotted Owl, Piping Plover, and Whooping Crane(all considered threatened bird <br /> species); (b) the Pallid Sturgeon(and endangered fish); and, (c)the Colorado Butterfly Plant, Ute Ladies' <br /> Tresses, and Western Prairie Fringed Orchid (all considered threatened flowering plants). The desktop <br /> review and field assessment concluded that the potential for occurrence within the Project area,for each/any <br /> of these species was"not likely". <br /> State Species: A total of four State-listed species were identified as having the potential to occur within the <br /> Project area or that have the potential to be affected by the proposed Project. These include: (a) the <br /> Burrowing Owl and Mountain Plover(bird species subject to the Migratory Bird Treaty Act and considered <br /> State Threatened Species and State Special Concern Species,respectively;both of which are considered as <br /> having"possible"potential occurrence within the site; and, (b) the Black-Tailed Prairie Dog (a species of <br /> State Special Concern;occurrence potential of"not likely")and Plains Pocket Gopher(occurrence potential <br /> of"likely"), both mammalian species. The CPW District Wildlife Manager was contacted on January 7, <br /> 2019, regarding species of concern in the project area to obtain additional information. The District <br /> Manager stated that CPW generally requests a 30-day window for reviewing land use proposals, and that <br /> he could provide comments once CPW receives the Use by Special Review(USR)notice from Weld County <br /> planning Department. As of the date of this report,no response from CPW has been received. <br /> In summary, preliminary determinations suggest that the presence of Federally-listed threatened, <br /> endangered, proposed, or candidate species is unlikely (subject to USFWS concurrence).
