EXHIBIT D MINING PLAN Unless specifically discussed below, the methods described and approved in the original permit application and the Mining and Reclamation Plans will remain unchanged just the sizes of the affected Areas were adjusted to reflect the change . This will remain a dry mining operation, with the active mining area being dewatered as needed. MAP EXHIBIT C shows the current permit area and the area being added to the permit . The primary reason for this amendment is to add 2 . 09 acres ± on the northern side of Area 3 . This parcel was purchased in 2019 from the Town of Firestone . Mining it will allow us to increase the water storage capacity of Area 3 and make the north shore of the reservoir more uniform. Discussions are underway with the Last Change Ditch Company that would allow for potentially relocating the Last Chance Ditch around the perimeter of the mine and then removing the material under the ditch and bordering setbacks . If this happens, L.G. Everist, Inc . would file a Technical Revision to update the Mining Timetable and Mining Plan Map showing the final location of the ditch. We revised MAP EXHIBIT C -CURRENT CONDITIONS MAP and MAP EXHIBIT-C-1 MINING PLAN MAP since the conditions at the mine have changed since the 2010 amendment was approved and the January 2019 Technical Revision was approved, that allowed for construction of addi- tional settling ponds and removal of some of the peninsulas that contained oil/gas wells that have been abandoned and plugged. Since the Technical Revision 01, another gas well was plugged and abandoned in Area 5 on the east side . We have removed this peninsulas from the maps and adjusted the timetables to reflect the changes .
