4 <br /> M <br /> o Surface Drainage Plans <br /> Erosion Control Plans <br /> o Revegetation Plans <br /> The grading, drainage, and erosion control plans required above shall be prepared and signed by an engineer <br /> licensed in the State of Colorado having knowledge and experience in civil engineering in accordance with Sections <br /> 6207 and 7102.05 of the Code. The revegetation plan required above shall meet the standards set forth in Section <br /> 7101 A I.D of the Code and shall be prepared by an individual having a degree in landscape architecture or <br /> comparable expertise, and sufficient experience in landscaping installation and maintenance to ensure the success <br /> of the plans they propose in accordance with Section 7102.06 of the Code. <br /> Due to unique site considerations, the Engineering Department requires you to submit an executed site <br /> improvements agreement and financial guarantee acceptable to the Engineering Department prior to issuing a <br /> grading permit in accordance with Section 6302.06 of the Code. Unique site considerations include, but are not <br /> limited to: <br /> • Hazardous conditions that are likely to occur as a result of incomplete or improper grading; <br /> • Potential adverse effects on the surrounding environment, properties or community as a result of <br /> incomplete or improper grading; and <br /> • Adverse geological or environmental impacts as a result of incomplete or improper grading. <br /> As stated in the third letter, you were required to submit an application for permits to resolve these violations <br /> prior to January 15, 2019, with completion of all related work by July 15, 2019. In consideration of concurrent <br /> action by the State of Colorado DRMS, which specified a submittal deadline of April 25, 2019, we extended our <br /> submittal date to April 25,2019. Each of these dates have now passed,without the required submittals.Therefore, <br /> if these materials are not submitted by May 31,2019 we will have no choice but to refer this matter to the County <br /> Attorney's office for further action. Potential remedies include criminal or civil penalties pursuant to Colorado <br /> Revised Statutes §§30-28-124(1)(c) and 30-28-209. <br /> In providing you with this information and your fourth and final notice,we want to impress upon you that the <br /> County takes such violations seriously and is obligated by law to rectify them. Please contact our office <br /> immediately to set up an appointment to discuss how these issues will be addressed.
