iii. Final stabilization of the site is required by establishing
uniform vegetative cover at the site at a minimum density of 70% of pre-
disturbance levels.
C. Private Agreement between LGI and landowner:
i. Requires LGI to repair any damage that LGI causes to the
land.
ii. Requires LGI to stockpile the top soil from the affected area
when removing the fill, and then restore the surface of the affected land to
the same or as good a condition as existed immediately preceding prior to
removing the fill from the landowner's property, by redistributing the topsoil
evenly across the site, and seeding the affected area with a grass type of
landowner's choice at time of seeding.
15. Do you have permits for this activity from other governmental agencies such as
building, construction or grading permits, and if so, what are they?
a. Grading Permit issued by Town of Bennett, Department of
Building and Safety.
b. The Town of Bennett has approved the GESC Plan and the
Town independently enforces remediation measures required in connection
with taking the fill from the site.
C. Department of Public Health and Environment, Water Quality
Control Division, Colorado Discharge Permit System General Permit.
16. Are there state/federal/local agency participants in terms of funding (yes)-(no),
design (yes)-(no). The state
and Town of Bennett approved the permits issued above and the GESC Plan.
17. What post mining uses will be made of the site of extraction and why?
The site will be returned to the same state it was in before the removal of the fill occurred.
The site is vacant land zoned for commercial uses. As mentioned there will be no
processing or use of chemicals at the site, or holes or pits at the site. The final grading
of the site will actually make the site better prepared for ground up commercial real estate
development. There is new residential development directly adjacent to the site, and the
grading of the property will likely make the site more attractive to real estate developers
that may desire to subdivide the site and build homes on the site. The site is also available
for agricultural use, such as grazing.
3
134509\000 1 8\94400345.v2
