a. Grading Erosion and Sediment Control ("GESC") Plans — SEE
ATTACHED PLANS approved by Town of Bennett. Some requirements of these
plans are listed below:
i. LGI must have a GESC manager that remains on site for the
majority of time and available to the Agency on a 24/7 basis.
ii. The Town of Bennett independently enforces remediation
measures required in connection with taking the fill from the site.
iii. Earth disturbances must be done in such a manner as to
minimize impact and protect natural features and vegetation.
iv. Once all fill related activities are complete at the site, LGI must
establish uniform vegetative cover at the site at a minimum density of 70%
of pre-disturbance levels.
V. All disturbed areas must be drill seeded and crimp mulched in
accordance with the Eastern Plains and Foothill Region in Native Plant
Vegetation Guide for Colorado.
vi. Once topsoil is removed and stockpiled from the site, an
Agency representative must inspect the stockpile or a stop work order will
be issued.
vii. Any adverse impacts to the site and any adjacent waterways,
wetlands or other properties resulting from LGI's removal of the fill must be
remediated.
viii. No permanent slopes greater than 4:1 are permitted.
ix. Inspections must be performed every 14 days.
b. Colorado Discharge Permit System General Permit. SEE
ATTACHED STATE ISSUED PERMIT. Although the General Permit regulates
discharges of water, the preventative and remediation requirements of the General
Permit ensure that the affected property will be reclaimed to a beneficial land use
once LGI's activities are complete:
i. Topsoil is to be preserved for those areas of a site that will
utilize vegetative final stabilization.
ii. The amount of soil exposed during any activity on the site
must be minimized including the disturbance of any steep slopes.
2
134509\000 1 8\94400345.v2
