2.05.6 Mitigation of the Impacts of Mining Operations
(1) Air Pollution Control Plan
(1)(a) All permit applications for new operations shall contain a copy of
the application for an emission permit and shall be updated
accordingly as initial or final decisions are rendered.
A copy of the emission permits are presented in Volume II,
Appendix E, Air Pollution Emission Permits. The emission permits
are actually referred to as construction permits.
(1)(b) Other than the above referenced air emission permits, no other
permit applications are known to be necessary to comply with other
applicable State or Federal air quality laws or regulations.
(2) Fish and Wildlife Plan
(a) A Baseline Wildlife report is presented and discussed in Section
2.04-11.
(a)(i) The Division of Wildlife's (DOW)letter dated February 1,
2008 located in Volume II, Tab Q, summarizes its concerns
about the McClane Canyon Mine's proposed coal mine
waste disposal area. Their concerns are related to the small
TR -16 coal mine waste pile and projected water impacts.
Water depletions in the Upper Colorado River Basin have
been recognized as a major source of impact to endangered
fish species (USFWS 2/93). The Applicant agrees to
implement the conservation measures that the USFWS
believes are necessary to offset the water depletion impact.
See Appendix P for the estimated water consumption
(depletion) by the mining. See Section 2.04-11 for a full
discussion of the potential for impacts to rare and
endangered species, and USFWS required conservation
measures.
PR -02 2.05-53 10/12
