2.05.4 Reclamation Plan <br />RULE 2.06.5 (2) <br />(a) As detailed above, this request for variance is intended to allow the <br />Applicant to reclaim the mine bench to a stable condition. Reclamation to <br />AOC would not be stable enough to meet the requirements of 4.14.2(1)(b). <br />When reclaimed to a stable condition, the mine site area will be suitable for <br />the intended postmining land use. <br />(b) The area will be returned to the identical land use which existed prior to <br />mining; specifically, rangeland and fish and wildlife habitat. <br />(c) See (b) <br />(d)(i) Reclamation of the area to stable slopes, because they are not as <br />steep as those existing prior to mining, will help to reduce contributions of <br />suspended solids from the 1.5% of the McClane Canyon watershed which is <br />effected by the operation. <br />(d)(ii) The area of the McClane Canyon watershed is approximately 483 <br />acres. That portion of the permit area which will not be reclaimed to AOC is <br />approximately 2 acres or 0.41 % of the total. Since the disturbance is so <br />small relative to the total area involved, no effect to the total volume of flows <br />is anticipated. <br />(d)(iii) It is assumed that the DRMS is the only agency that will review the <br />plan. If however, additional agencies become involved, there should be no <br />objections to the plan because there are no other environmentally sound <br />ways to reclaim the area. <br />(e) The mine site is located on Federal Coal Lease # C-0125439. The US <br />Bureau of Land Management, Grand Junction Resource Area has reviewed <br />the plans for reclamation of the mine site and have requested that the <br />Applicant be allowed to reclaim the area as shown on the plans. The letter of <br />request is contained in Appendix K. <br />(f) Responses to all requirements of 4.27.4 are detailed below. <br />(g) All requirements of the Act, the regulatory program and the rules of the <br />Division, including but not limited to 2.06.5 and 4.27.4 will be complied with. <br />PR -02 2.05-35- 10/12 <br />
