Coal Ridge No. 1 Mine C-1984-065: MT-08 April 2, 2019 <br /> <br />Page 8 of 27 <br /> <br />operation which are not discussed in this midterm review have been complied with or terminated. As of <br />the time of this midterm permit review, there are no active or un-resolved stipulations to the Coal Ridge <br />No. 1 mining permit. <br /> <br />Section IV - Enforcement Actions <br /> <br />There has been no enforcement action taken in the last two and a half years since approval of RN-07. <br /> <br />Section V - Identified Issues <br /> <br />Pursuant to 2.08.3, the Division finds that the permit application C1984-065 possibly contains five <br />deficiencies following the review for the purpose of fulfilling the requirements of the Colorado Surface <br />Coal Mining Reclamation Act, and the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. The Division requests that the permittee correct the deficiencies by submission of revised <br />permit pages under appropriate revision applications, or by activities on the ground, by 60 days after <br />issuance of the MT-08. <br /> <br />1. Please verify that the information in Section 2.2 - Identification of Interests of PAP is current, <br />including permittee ownership and control information, surface and mineral ownership, and <br />permittee compliance information. If the information is outdated, please submit a minor revision to <br />update the information. <br /> <br />2. Please verify that the information in Section 3.7.6 – Threatened and Endangered Species of the PAP <br />is current. If the information is outdated, please update the information as necessary. <br /> <br />3. In Section 4.5 – Post Mining Land Use, the word “proposed” is used multiple times within the <br />section. Section 4.5 was last updated with the approval and issuance of TR-21 and the changes are <br />no longer being proposed. Please update Section 4.5 to remove the use of “proposed” when <br />discussing approved land uses for the Coal Ridge No. 1 Mine. <br /> <br />4. Page 4-68 within Section 4.5, references a signed document of the landowner consent in regards to <br />the approval of an alternative land use with TR-21. However, with the approval and issuance of TR- <br />22, there has been a change of landowner in which the land Coal Ridge No. 1 Mine resides in and <br />this agreement is no longer pertinent. Please update Section 4.5 as necessary. <br /> <br />5. As part of TR-22, C. B. Minerals Company, LLC, incorporated a new right-of-entry agreement with <br />the new landowner. In that agreement, the landowner discusses the possibility of farming organic <br />produce in 2019. While the permit area of the Coal Ridge No. 1 Mine is compatible with Garfield <br />County Zoning regulation of Agriculture/PUD, the approved post-mining land use is currently <br />approved for rangeland (dry land pasture) and wildlife habitat. If necessary, please update Section <br />4.5 and other associated sections and figures to include agriculture use. <br /> <br /> <br />Section VI - Bonding <br /> <br />The Division currently holds a certificate of deposit in the amount of $43,200.00 for reclamation at the
