In accordance with <br /> Construction Material Rule 3.1.5(9), the following information is provided in support of this Notice: <br /> (a) Inert fill material will be obtained from a variety of off-site sources within the vicinity of the <br /> Wattenberg site from time to time as such inert materials from excavation activities for <br /> construction of basements and buildings, land clearing, demolition projects, and road and <br /> highway construction become available. The off-site materials will be accepted in accordance <br /> with Aggregate's "Inert Material Acceptance Policy" a copy of which is enclosed as Exhibit B. <br /> This material will be incorporated into the reclamation of the sand and gravel mine site <br /> operated under MLRB 112c Permit No. M-2004-051, located at 1206 County Road 23 3/, <br /> Brighton, Colorado 80603. <br /> (b) The approximate volume of inert material to be imported and backfilled as set forth in (a) <br /> above is estimated to be approximately 300,000-500,000 cubic yards. <br /> (c) Enclosed as Exhibit D is an affidavit certifying that the material to be imported is clean and <br /> inert, as defined in Rule 1.1(20). In accordance with the above-referenced Policy, Aggregate <br /> also obtains and maintains on file an"Inert Fill Materials Profile Form" form, a copy of which <br /> is enclosed as Exhibit C. <br /> (d) It is anticipated that hauling of import material to the site and backfilling with the imported <br /> material would commence upon approval by the Division of this Notice or, if the Division does <br /> not respond, within thirty (30) days of the Division's receipt of this Notice. <br /> (e) Importation is expected to continue for three to six years after commencing the backfilling <br /> operations. <br /> Page 1 of 2 <br />
