EXHIBIT M OTHER PERMITS REQUIRED <br /> The following permits are necessary for the full operation of the BRS&G Pit 1: <br /> 1. Local permits— Delta County Specific Development Permit <br /> 2. NPDES combined process water/storm water discharge permit—A NPDES permit will be <br /> needed from the Colorado Department of Public Health and Environment since water will <br /> be pumped offsite to the Gunnison River. <br /> 3. APEN—A fugitive air emissions permit is needed from the Colorado Department of Public <br /> Health and Environment since the site will mine more than 70,000 tons per year. Air <br /> emissions permits will be in place for all equipment utilized on site which requires a permit. <br /> 4. Gravel Well Permit—A Gravel Well Permit with the Colorado Division of Water Resources <br /> must be obtained since the site will partially be reclaimed as a lake.
