ARCOSA <br /> 1112 E Copeland Road,Suite 500 <br /> Arlington TX 76011 <br /> T 817635.8525 <br /> Exhibit S— Permanent Manmade Structures <br /> The map provided in Exhibit C shows the permanent manmade structures located within 200 feet of the <br /> affected lands boundary. The mining methods used by Arcosa to mine the shale do not involve blasting <br /> or other activities that would cause significant ground vibration. Rather, conventional equipment such <br /> as dozers, loaders, and haul trucks are used to extract the shale. <br /> A summary of the permanent manmade structures located within 200 feet of the affected lands area is <br /> provided below, which correspond to structures identified on Exhibit C. Arcosa has mailed structure <br /> agreements to owners of manmade structures. Copies of these mailed agreements are Attached. <br /> Colorado Highway 93 <br /> Colorado Highway 93 runs north/south through the middle of the affected lands area. The highway is <br /> owned and maintained by the Colorado Department of Transportation (CDOT). The mine area is <br /> located to the west of the highway. Mined material is conveyed via a conveyor belt beneath Highway 93 <br /> to the east side of the road where it is processed. Arcosa has been in communication with CDOT to <br /> obtain a letter stating that Arcosa operations will not impact the highway. A copy of a figure that shows <br /> proximity of Arcosa's mining activities to Highway 93 as well as email correspondence between Arcosa <br /> and CDOT is included in the attachments. <br /> CenturyLink <br /> CenturyLink provides data services to the process area of the facility. Arcosa has been in contact with <br /> Century Link to obtain a letter stating that Arcosa's operations will have no negative effect on <br /> CenturyLink's assets. <br /> Xcel Energy <br /> Xcel Energy supplies electricity and natural gas to the facility. Arcosa has been in contact with Xcel <br /> Energy to obtain a letter stating that Arcosa's operations will have no negative effect on Xcel's assets. <br /> US Department of Energy/ NREL Sub-station <br /> The US Department of Energy (DOE), National Renewable Energy Lab (NREL) owns the property <br /> directly to the east of the Arcosa processing facility. A sub-station and transmission lines are currently <br /> under construction to transmit energy from wind towers located nearby. DOE also has several dirt roads <br /> located within the 200-foot offset. Arcosa is in contact with DOE/NREL to obtain a letter of"no negative <br /> effect" or a Structure Agreement, a copy of which will be provided to DRMS once it is received. If an <br /> agreement cannot be reached, Arcosa will conduct an engineering evaluation to demonstrate no <br /> impacts to the DOE structures. <br /> John C. Hogan Property <br /> The Hogan property borders to the south and west of Arcosa's leased lands. There are several <br /> structures located within 200 feet of the affected lands boundary. A majority of these structures are <br /> located a significant distance from active operations. These structures include: <br /> • Driveway and access roads <br /> • Fencing <br /> • Small ponds and debris pile; and <br />
