Performance and Financial Warranties
You must submit a performance warranty and a financial warranty in an amount determined by
the Board prior to permit issuance.* Several different types of financial warranty are
allowed by the law. You should determine what type of financial warranty you desire to use
and obtain the appropriate forms from the Mined Land Reclamation Division durina the
application review period to facilitate finalization of an acceptable financial warranty and
permit issuance.
Compliance with Other Laws
Section 115 of the Act reauires a permit application be in compliance with all applicable
local , State, and Federal laws. We suaaest you contact the following_ agencies to determine
whether you need to comply with their legal reouirements:
C.R.S. 34-32-109(6) reauires a mining operator to be responsible for assurina that the
minina operation and the post-mining land use comply with local land use regulations and
any master plan for extraction adopted pursuant to Section 34-1 -304.
State Enaineer with reaard to the. administration of water riahts:
Colorado Department of Health with reaard to the discharge of Dollutants into the waters
of the State;
Colorado Department of Health with regard to the need for a fugitive dust Dermit: and
U.S. Army Corps of Engineers regarding a dredge and fill permit.
* If the applicant is a unit of State or county government, then only a performance
warranty is reauired.
