Please provide evidence(such as Proof of delivery of certired letter to structure owners) that <br /> a notarized agreement between the structure owners and the applicant was pursued. If an <br /> agreement is unable to be reached a geotechnical assessment may be provided to demonstrate <br /> that the structures shall not be damaged. <br /> You must provide information sufficient to demonstrate that the stability of any structures <br /> located within two hundred(200)feet of the operation or affected land will not be adversely <br /> affected. <br /> See the attached certified mail receipts as proof that structure agreements have been pursued. <br /> The Fairmount Fire Protection District and Jefferson County structures located within the mining <br /> limits are based on leases that each of these parties has with the landowner(Keller). These are <br /> annual or bi-annual renewing leases that have a 90-day termination clause for both the lessee and <br /> the lessor. Therefore, both Fairmount and Jefferson County will have sufficient warning to <br /> vacate the property prior to mining affecting their structures. <br /> Additional Information: <br /> You will also need to provide the Division with proof of notice publication.Any letters from other <br /> commenting agencies/entities received by the Division to date have been included with this <br /> correspondence for you to review.Asphalt Paving will be required to submit as part of the <br /> required annual reporting a geotechnical stability report that provides, at aminimum: <br /> 1) Provide an accurate description of the existing high-wall material(s),geotechnical <br /> characteristics, bench, and wall configuration. <br /> 2) Geotechnical evaluation of the stability of the existing high-wall configuration, with <br /> special consideration given to identify existing areas of potential weakness and/or <br /> instability, and for recommendations to correct these issues ifobserved. <br /> 3) Determination if the existing high-wall conforms to the requirements of existingpermit. <br /> 4) If the existing high-wall does not conform to the requirements of the existing permit, <br /> speck what additional work will be required to achieve the requiredconfiguration. <br /> S) This submittal shall be completed and certified by an independent, third party licensed <br /> geotechnical engineer. <br /> The geotechnical evaluation as described above be an enforceable part of the annual reporting <br /> requirements for this site until such time as a revision to justify the removal of this reporting <br /> requirement is approved by the Division. Please acknowledge. <br /> The applicant will provide, as part of the annual report, an evaluation of the existing highwalls <br /> (material, geotechnical characteristics, bench, and configuration), an evaluation of said highwall <br /> stability, a determination if the highwalls are in compliance with the approved permit, and an <br /> action plan for any non-compliant highwalls.
