Letter, DRMS. Ownership of parcel west of Schmidt Site, M-2011-014, 18 FEB 2019, Page 2 of 2 <br /> It was not our intent to deceive or confuse anyone by providing the original 2011 information. I <br /> apologize for any confusion this caused,as our only intent was to comply with the Division's <br /> requirements. There are other parcels in the vicinity for which ownership has changed between 2011 <br /> and 2018/2019. However, we verified the current owners from County GIS data before sending out the <br /> most recent requests for structure agreements, as well as determining if additional structures were <br /> present in 2018 that had not been present in 2011. <br /> Please note that the current owner, Mo's Rentals LLC, refused to sign a structures agreement, and that <br /> Mr. Danny Snow, who originally filed the complaint with the County and the Division regarding the small <br /> amount of dirt accidently pushed onto the Mo's Rentals LLC parcel, apparently is not either an owner of <br /> record of that parcel or of Mo's Rentals LLC and is not (according to the Colorado Secretary of State's <br /> records) a registered agent of Mo's Rentals LLC. We understand that he may be an owner and/or <br /> employee of Mo's Rentals LLC:. He is the one owner of potentially significant and permanent manmade <br /> structures within 200 feet of the Schmidt Site who refused to accept the certified letter requesting a <br /> structures agreement which was sent by the Schmidts, according to USPS records. <br /> State Engineer Office (SEO) records have a total of three water wells which may be within 200 feet of <br /> the Schmidt Site.There may be other, unrecorded/unreported wells. It is my professional opinion, based <br /> on the distance and well depth relative to the excavations (already at maximum within 200 feet of the <br /> three wells),the excavation at the Schmidt Site has not and will not have any impact or effect on any of <br /> the three known wells.The information below is measured from USGS, SEO, Archuleta County GIS, and <br /> Google Earth photos and maps, and is estimated. <br /> 1. Permit# 144742 originally by Ted Davis and now on property owned by Dan Snow, is located to <br /> the west and is 100 feet deep with top of hole (TOH) at elevation 6963, 190 feet from the <br /> Schmidt Site boundary and 200 feet from the nearest excavation (max depth elev 6966). <br /> 2. Permit#184022 on property owned by Dan Snow, is located to the north (across River Run <br /> Drive) and is 10 feet deep (in the alluvium) with TOH elev 6945, 110 feet from the Schmidt Site <br /> boundary and 180 feet from the nearest excavation (max depth elev 6966). <br /> 3. Permit#241357 originally by Matt Johnson and now on property owned by Sue Moak, is located <br /> to the east. The SEO mapping appears to be in error, as it shows the location near the NW <br /> corner of the Moak property, but there is no well (or any other structure)there, and the <br /> wellhouse location as identified in 2011 is near the houses and sheds on the property and is 260 <br /> feet deep with TOH at 6988, about 200 feet from the Schmidt Site and 210 feet from the nearest <br /> excavation (max depth elev 6960). <br /> Sincerely, <br /> Nathan A.
