This inspection was scheduled in accordance with Section 3.03.2(2) <br />of the Rules, in response to ERMR’s SL-2 bond release application. A coal complete inspection was conducted <br />simultaneously with the bond release inspection. The weather conditions were cloudy and cold. The temperature <br />was approximately 35F and the ground was muddy and partly snow covered. <br /> <br />ERMR requested a phase I bond release on the Garvey property. The inspection began as a meeting with the <br />surface owners at 10:00 a.m. on February 13, 2019 at the mine office. In attendence for the SL-2 meeting were: <br />Frank Ferris (ERMR), Tony Tennyson (Tri-State), Stan Garvey (landowner), Joe Garvey (landowner) and Dustin <br />Garvey (landowner). OSM was invited to the inspection but was unable to attend. <br /> <br />AVAILABILITY OF RECORDS – Rule 5.02.4(1): <br /> All required records were on file and available for review at the mine office. No problems were noted <br />with the records review. Please see the availability of records checklist at the end of this report. <br /> <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> As part of the bond release inspection, the group gathered at the southern entrance on the Garvey property. <br />The ground conditions were very muddy and it was decided not to walk on the reclamation as some of it has <br />already been seeded. The Garvey’s have worked closely with the mine staff while the pit was being backfilled, <br />graded and topsoiled. The Garvey’s were also part of the team that installed the center irrigation pivot (photo 1). <br />The pivot was turned on last fall and irrigated the northern part of the reclamation. The Garvey’s were happy with <br />the pivot’s performance. The Garvey’s were also happy with the final contours of the land and the topsoil <br />placement. <br />
