This inspection was scheduled in accordance with Section 3.03.2(2) of the Rules, <br />in response to ERMR’s SL-21 bond release application. A coal partial inspection was conducted simultaneously <br />with the bond release inspection. The weather conditions were cloudy and cold. The temperature was <br />approximately 35F and the ground was muddy and partly snow covered. <br /> <br />ERMR requested a phase I, II and III bond release for the C-18 ditch on the Staats’ property. The inspection began <br />as a meeting with the surface owners at 10:00 a.m. on February 13, 2019 at the mine office. In attendence for the <br />SL-21 meeting were: Frank Ferris (ERMR), Tony Tennyson (Tri-State), LeaAnn and Mel Staats (landowners). <br />OSM was invited to the inspection but was unable to attend. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> Ponds 15 and 16 did not contain water. Pond 12 was inaccessible. <br /> <br />Ponds 9 and 13 contained water. The ponds were not walked and closely inspected due to the muddy conditions. <br /> <br />Pond 18 contained a small amount of water but was not discharging.
