As of the date of this letter,we received <br /> two notarized agreements back, one from Western Area Power Authority and one from DCP Midstream, <br /> both which are also attached. Atmos Energy provided a letter which stated that Tollgate Pit would have no <br /> impact, see attached letter. <br /> ADDITIONAL INFORMATION: <br /> Please see the attached proof of notice publication and notice to adjacent landowners within 200 feet of any <br /> affected lands. <br /> The letter from the Office of Archaeology and Historic Preservation has been noted. The letter from the <br /> Department of Natural Resources Division 1,District 3 Water Commissioner has been noted,as well.Prior <br /> to the use or exposure of any ground water for the operation,the required well permit and a substitute water <br /> supply plan or decreed plan for augmentation will be obtained. Stormwater runoff that is intercepted by this <br /> operation will be released to the stream system within 72 hours and, if not, replacements for evaporation <br /> will be made. <br /> The following is a list of all attached items to this letter: <br /> 1. Updated mining plan map(s): one map displays the mining plan itself along with the structures on <br /> and near the site.The complementary map shows the adjacent land owners. <br /> 2. Updated reclamation plan map. <br /> 3. Proof of on-site public notice. <br /> 4. Proof of certified mail to all adjacent land owners. <br /> 5. Proof of certified mail to all structure owners,returned/notarized structure agreements. <br /> 6. Proof of newspaper publication. <br /> 7.
