DNR COLORADO <br /> CO 4.1. of Reclamation, <br /> • Mining and Safety <br /> 1313 Sherman Street,Room 215 <br /> Denver,Colorado 80203 <br /> February 5,2019 <br /> LG Everist Inc. <br /> Attn: Lynn Mayer Shults <br /> 7321 E 88th Ave Ste 200 <br /> Henderson CO 80640 <br /> RE: File M1996-052; Firestone Gravel Resource; Technical Revision 01 (TR01), DRMS <br /> Request for Additional Information <br /> Ms. Mayer Shults: <br /> The Division of Reclamation, Mining and Safety(DRMS)received the complete Technical <br /> Revision 01 (TR01)request for the Firestone Gravel Resource site on January 31,2019. The <br /> decision date for this TR is currently March 4,2019. DRMS has reviewed the submitted request <br /> to revise the mining and reclamation plan and adjust the bond as required, and to correct some <br /> minor errors in permit acreage. <br /> With respect to the permit acreage corrections,the total current permitted acreage will be <br /> corrected to 342.79 acres. This will correct the rounding error from the initial permitting in 1996 <br /> (0.29 ac), and add back the 4.07 acres that were included in the total 27.98 acre parcel described <br /> and released in 2018,but were not permitted-per the description/discussion included in the TR. <br /> There was also a request in TRO1 to add 2.09 acres to the permit. This area is part of a parcel that <br /> was previously owned by Firestone and surrounded on 3 sides by the existing permit,but is now <br /> owned by LG Everist. As previously discussed, if LG Everist wishes to add this acreage to the <br /> permit, they will need to do so through a permit amendment. The Division cannot add acreage to <br /> a permit except through the Permit Amendment process. <br /> The Division will accept the proposed changes to the mining and reclamation plans as submitted <br /> and raise the maximum disturbed acreage from 85 to 180 as stated. I would recommend that LG <br /> Everest remove the maximum disturbed acreage condition to avoid further issues, and just bond <br /> as appropriate for the existing and proposed disturbance. <br /> It is my understanding at this time that groundwater has not yet been exposed in Stages 4 and 5, <br /> and that Stage 1 will be filled to above static groundwater level with fines and revegetated. <br /> However,DRMS will require additional information to calculate the required bond for the clay <br /> lined reservoir areas—specifically at this time the cost of the clay liners for Stages 2 and 3. LG <br /> Everist will be required to notify DRMS prior to exposure of groundwater in Stages 4 and 5 so <br /> that the bond can be adjusted appropriately. <br /> The liability to the State for areas of exposed groundwater exists until the State Engineer's Office <br /> (SEO)approves the installed liner. Therefore, DRMS will bond for the full cost of liner <br /> installation(compacted clay, or slurry wall) for the entire stage, for any stage or cell where <br /> groundwater has been exposed, until the liner is approved by the SEO.
