diluted exponentially, diluted flocculant values proposed for use at the Box Creek Placer will <br /> have a negligible effect to surrounding waterways. <br /> Regardless, the sediment settling ponds are a `closed loop system' with no discharge so the <br /> likelihood of any unanticipated releases is extremely low to nonexistent. Concentrated flocculant <br /> may pose a threat to the environment but secondary containment will be utilized that is capable <br /> of holding 110%of the flocculant tanks contents. Titan Au commits to using flocculant to the <br /> prescribed concentrations detailed in the included MSDS sheet and will therefore have minimal <br /> to no effects to groundwater quality and the environment. Lastly, in the past, Lewicki and <br /> Associates has worked with Michael Cunningham of the DRMS with regard to flocculant use in <br /> the placer mines of the Alma-Fairplay area; he may be able to share further insights into the <br /> effects of flocculant to the environment in such low concentrations. <br /> 5. Rule 3.1.6 (1)(a) requires that operations comply with all applicable Colorado water laws <br /> and regulations. State law requires that persons exposing groundwater through open <br /> mining obtain a well permit from the state engineer. Please commit to obtaining a well <br /> permit for the operation and a water court approved augmentation plan prior to exposing <br /> any groundwater at the site. <br /> A gravel well permit is in process with the Colorado Division of Water Resources and the state <br /> engineer.No ground will be disturbed and no groundwater will be encountered prior to securing <br /> an approved well permit. An augmentation plan is not necessary as no exposed water produced <br /> as the result of these mining efforts will remain during reclamation. A substitute water supply <br /> plan is in process with the Colorado Division of Water Resources. No ground will be disturbed <br /> and no groundwater will be encountered prior to securing an approved substitute water supply <br /> plan. <br /> Furthermore,the worst case reclamation scenario consists of filling the current open mine phase <br /> to prevent permanent surface water exposure. The open sediment settling pond will experience <br /> passive evaporation once mining is completed. The area will then be topsoiled and seeded and <br /> will not permanently impound water following the termination of mining activities. <br /> 6. For the Xcel Energy power poles and BR Pipeline,pursuant to Rule 6.4.20 (c), please <br /> provide a notarized letter, on the utility company letterhead, from the owners of the <br /> utility, stating that the mining and reclamation activities, as proposed, will have no <br /> negative effect on the utility. <br /> While communication with both Xcel Energy and the BR Pipeline Company is currently initiated <br /> and under pursuit, it is not anticipated that a written letter from each company will be produced <br /> prior to the anticipated start date of mining. Certified mail structure agreements were sent to both <br /> utility companies and were signed received and returned to Lewicki and Associates in 2018. <br /> Structure Agreements are signed and notarized by the Operator, Mindy Miller, and commit Titan <br /> Au to repair and compensation of any damaged structures. <br /> The previous mining plan, detailed on Map C-2 found in the application file, shows a 200 foot <br /> buffer with 100 feet on either side of the BR Pipeline trend. The current mining plan map C-2 <br /> dated 190129 and submitted herein shows a 400 foot buffer with 200 feet on either side of the <br /> BR Pipeline trend and effectively precludes the entire pipeline from the within 200 feet of the <br />
