Please accept this letter as our <br /> "Engineering Evaluation" based on Option "B" of the standard Structure Agreement: <br /> "Where such an agreement cannot be reached, the Applicant shall provide an appropriate <br /> engineering evaluation that demonstrates that such structure shall not be damaged by <br /> activities occurring at the mining operation" <br /> The irrigation canal is directly adjacent to and north of the northeast permit boundary of the <br /> mine. For the original permit, Rocky Ford Highline Canal provided a letter stating their <br /> concerns (see attached). Their biggest concern was potential silt runoff in to the canal. They <br /> also requested the Operator not mine below the elevation of the top of the canal and that they <br /> always have access to the canal. <br /> Earthen berms have been constructed to mitigate erosion and sedimentation due to stormwater <br /> runoff to the canal. To my knowledge, no mining has occurred below the elevation of the top of <br /> the canal and none is planned. The Operator has previousley committed to maintaining at least <br /> 25 feet between the canal and mining operations. <br /> It is my opinion that a "Slope Stability/Geotechnical Analyses" is not warranted for this structure <br /> because no excavation is planned below the top of the structure. <br /> However, the Operator must maintain the berms, slopes above the canal, and the 25 feet <br /> setback to ensure potential conveyance of soils is mitigated. <br /> a <br /> If you have any questions, please call me at 719-547-7073.
