4.8 Conveyance. To sell,mortgage,bequeath,donate,or lease the Property. Any <br /> conveyance or lease will remain subject to the terms of the Conservation Easement and any <br /> subsequent owners or lessees will be bound by all obligations in this agreement. <br /> 4.9 Mineral Extraction. To explore for,develop and extract oil,natural gas and <br /> other hydrocarbons provided that such extraction is not accomplished by any surface mining method <br /> and the method of extraction has a limited,localized impact on the Property that is not irremediably <br /> destructive of the Conservation Values of the Property, and further, provided that the proposed <br /> extraction will not substantially diminish or impair any of the Conservation Values of the Property. <br /> Prior to engaging in any mineral exploration,development or extraction by any method not prohibited <br /> by this paragraph,Grantor must notify Grantee and submit a plan for Grantee's approval that provides <br /> for minimizing the adverse effects of the operation on the Conservation Values of the Property. In <br /> addition to such other measures as Grantee may reasonably require to protect the Conservation <br /> Values of the Property,the plan must provide for: <br /> (i) Concealing all facilities or otherwise locating them to be compatible <br /> with existing topography and landscape to the greatest practicable extent; <br /> (u) Mini 'ping construction of any new roadways and locating and <br /> constructing such roadways so as to minimize adverse effects of the roadways on the <br /> Conservation Values of the Property;and <br /> (iii) Restoring any altered physical features of the land,including drill sites <br /> and roadways, to their original state and reclaiming the restored topography with <br /> appropriate native vegetation. <br /> Grantee may reasonably object to any proposed plan if any aspect of the plan would <br /> diminish or impair one or more of the Conservation Values of the Property. <br /> 4.10 J7tWty Lines. To construct, develop,maintain, repair and operate pipeline <br /> facilities, sewer line facilities, electrical lines,natural gas lines, telephone and cable television lines <br /> provided that such utility lines (whether overhead or underground) must be installed in a manner <br /> which will minimise damage to the surface of the Property and Grantor must restore and re-vegetate <br /> any disturbed ground with vegetation substantially similar to the vegetation that existed prior to the <br /> installation. <br /> 4.11 Dry-Up Agreement and Interruptible Supply Atireement.To comply with <br /> the terms and conditions of the Dry-Up Agreement and the Interruptible Supply Agreement and to do <br /> all things necessary and perform all duties and obligations required thereunder while minimizing the <br /> adverse effects thereof on the Conservation Values of the Property. Grantee acknowledges and <br /> understands Grantor's duties and obligations under the Dry-Up Agreement and the Interruptible <br /> Supply Agreement. <br /> 4.12 Government Conservation Programs. To participate in and cause the <br /> Property to be subject to the restrictions of any government conservation programs, including, <br /> without limitation, the Conservation Reserve Program and the Wetland Reserve Program.
