4.6 Soll Conservation. To control soil erosion, conserve soil and existing <br /> desirable vegetation and control weeds, invasive and non-native plants and parasitic plants on the <br /> Property in a manner consistent with good conservation practices as established by the Natural <br /> Resource Conservation Service or any successor governmental agency with similar interests and <br /> purposes. Notwithstanding this reserved right,Grantor has the responsibility to control weeds in a <br /> manner consistent with state laws and county ordinances,subject to the following: <br /> (i) All control techniques shall be consistent with the labeled instructions <br /> of the application materials which constitute the reasonable minimum necessary to <br /> control and/or eradicate the weeds, and which reasonably minimize impacts on the <br /> Conservation Values of the Property; <br /> (ii) Aerial application of any weed control is prohibited without Grantee's <br /> prior written approval; provided,however, if such application is required under the <br /> terms of the Dry-Up Agreement,Grantee's prior written consent shall not be required; <br /> (iiii) Biological('insect)control of weeds which do not materially adversely <br /> impact any of the Conservation Values of the Property shall be deemed consistent <br /> with the purposes of this Easement. <br /> 4.7 Limited Hunting Activities. To hunt large or small game on the Property <br /> subject to any restrictions imposed by the Colorado Division of Wildlife and to manage the species <br /> i and wildlife habitat on the Property in exchange for Fees (as defined above)upon the terms and <br /> conditions set forth below;provided,however, Grantor may not permit Commercial Hunting: <br /> (i) For purposes of species and wildlife habitat management,Grantor may <br /> allow third parties to hunt on the Property in exchange for Fees paid to Grantor; <br /> provided, however, that Grantor must limit the number of hunters allowed on the <br /> Property to six individuals per species hunted per year,and <br /> (ii) Grantor desires and agrees to remit to Grantee twenty-five percent <br /> (25%) of the fair market value of any Fees collected by Grantor from a third party <br /> (excluding family members of Grantor's owners)in exchange for the right to hunt on <br /> the Property; provided, however, that Grantee invests the Fees in or otherwise <br /> contributes the Fees to: (A) conservation projects undertaken by Grantee (its <br /> successors or assigns) or any tax-exempt nonprofit organization, qualified under <br /> Sections 501(c)(3) and 170(h) of the Code, whose primary purpose is the <br /> preservation, protection, or enhancement of land in its natural, scenic, historical, <br /> agricultural,forested,and/or open space condition;or(B)any program conducted by <br /> tax-exempt nonprofit organizations,qualified under Section 501(c)(3) of the Code, <br /> that support the physically or mentally disabled,the economically disadvantaged, or <br /> victims of domestic violence in the southeastern Colorado region. <br /> 509921 <br /> Papa 7 of 20 <br /> {00234618/3} ProWsrs County, CO DEASE 0 101 8012,�1D 0 so <br /> 2 m6P Page 7 <br />
