CONDITIONAL PERMIT TO CONSTRUCT AND OPERATE <br />On the basis of the findings set forth in II above, and pursuant to the <br />authority (as delegated by the Administrator)of 40 CFR 52.21(r)(2)(vii) <br />(as amended June 19, 1978, 43 FR 26388), EPA hereby grants approval to <br />the Applicant to commence construction and operation of the Source. <br />This approval is expressly conditioned as follows: <br />(1) The Source shall not process more than 3.0 million tons <br />of coal per year. <br />(2) The Applicant shall not cause to be discharged into <br />the atmosphere from any coal processing and conveying <br />equipment, coal storage system, or coal transfer and <br />loading system processing coal, gases which exhibit <br />twenty (20) percent opacity or greater. <br />(3) The proposed control technology, i.e., enclosed conveyors, <br />baghouses, wet scrubbers, enclosed transfer houses, foam <br />dust suppressants, retractable loading chute, paved access <br />roads, etc., as described in the permit application, are <br />incorporated into this permit by reference. <br />(4) The Applicant shall notify the Denver Regional Office of <br />the U. S. Environmental Protection Agency (ATTN: Norman <br />Huey, 8AH-A), in writing, when construction and operation <br />of the Source commences. Such notification shall be <br />submitted within ten (10) days of the commencement of <br />construction and ten (10) days of the commencement of <br />operation. <br />(5) No condition herein shall excuse the Applicant from <br />complying with the provisions of the Colorado State <br />Implementation Plan, 40 CFR, Part 52, Subpart G, nor of <br />the responsibility for complying with all other appli- <br />cable federal, state or local regulations. <br />IV. GENERAL <br />This permit is issued in reliance upon the accuracy and completeness of <br />the information set forth in the Applicant's application to EPA for <br />permission to commence construction.
