111. CONDITIONAL PERMIT TO CONSTRUCT AND OPERATE
On the basis of the findings set forth in II above, and pursuant to the
authority (as delegated by the Administrator)of 40 CFR 52.21(r)(2)(vii)
(as amended June 19, 1978, 43 FR 26388), EPA hereby grants approval to
the Applicant to commence construction and operation of the Source.
This approval is expressly conditioned as follows:
(1) The Source shall not process more than 3.0 million tons
of coal per year.
(2) The Applicant shall not cause to be discharged into
the atmosphere from any coal processing and conveying
equipment, coal storage system, or coal transfer and
loading system processing coal, gases which exhibit
twenty (20) percent opacity or greater.
(3) The proposed control technology, i.e., enclosed conveyors,
baghouses, wet scrubbers, enclosed transfer houses, foam
dust suppressants, retractable loading chute, paved access
roads, etc., as described in the permit application, are
incorporated into this permit by reference.
(4) The Applicant shall notify the Denver Regional Office of
the U. S. Environmental Protection Agency (ATTN: Norman
Huey, 8AH-A), in writing, when construction and operation
of the Source commences. Such notification shall be
submitted within ten (10) days of the commencement of
construction and ten (10) days of the commencement of
operation.
(5) No condition herein shall excuse the Applicant from
complying with the provisions of the Colorado State
Implementation Plan, 40 CFR, Part 52, Subpart G, nor of
the responsibility for complying with all other appli-
cable federal, state or local regulations.
IV. GENERAL
This permit is issued in reliance upon the accuracy and completeness of
the information set forth in the Applicant's application to EPA for
permission to commence construction. The conditions herein become, upon
