CONDITIONAL PERMIT TO <br />COMMENCE CONSTRUCTION AND OPERATE <br />40 CFR 52.21(i) (43 FR 26388) <br />Significant Deterioration of Air Quality -- <br />Review of Major Stationary Sources <br />EMPIRE ENERGY CORPORATION <br />Eagle R5, 16, 717 and 749 Underground Coal Mines <br />and Surface Coal Handling Facilities <br />I. INTRODUCTION <br />The Empire Energy Corporation (hereinafter "the Applicant") plans to <br />construct and operate four new underground coal mines and a surface coal <br />handling facility (hereinafter "the Source") in Moffat County, Colorado, <br />near Craig. <br />On May 31, 1978, the Applicant requested from the Environmental Protec- <br />tion Agency, Region VIII (hereinafter "EPA"), permission to construct <br />the above source pursuant to the Prevention of Significant Deterioration <br />(PSD) Regulations, 40 CFR 52.21, as amended 43 FR 26388. EPA requested <br />and received additional information, and consequently, considered the <br />Company's application complete as of July 17, 1978. <br />On August 17, 1978, EPA published its preliminary determination to <br />conditionally approve the Company's request. No public comments or <br />requests for a public hearing were received in response to this notice, <br />or the notice issued by the State of Colorado on July 3, 1978. All <br />information considered by EPA in its review of the Company's request is <br />listed in Appendix I. j <br />i <br />f <br />II. FINDINGS <br />On the basis of the information listed in Appendix I, EPA has determined <br />that: <br />(1) The Applicant will meet all of the applicable requirements of <br />the PSO regulations. <br />
