<br /> <br />2. Under the second paragraph of the proposed Section 4.05.12 – Protection of Groundwater <br />Recharge Capacity, it appears a typo has occurred with the word “compliance” as spelled as <br />“ompliance”. However, as related to Division’s comment no. 1 of this letter (Comment 1), this <br />proposed section will need to be updated based upon discussions regarding groundwater points of <br />compliance at the Mine. <br /> <br />3. Under the final paragraph of the proposed page 4-17 it states, <br /> <br />…water quality in the Colowyo Mine Area is of degraded quality and has been <br />determined to be of limited use and quality. This determination has been support by <br />CDRMS through Findings of Compliance Documents for the Colowyo Mine (SL-05, SL- <br />10, and SL-12). <br /> <br />As discussed in the Division’s Comment 1 and attached memo, the Division has not made any <br />determinations of ground water classifications as it relates to Reg. 41 at the Mine. The WQCC is <br />the only Colorado regulatory agency with authority to officially make these determinations which <br />has not been done at the Mine and it remains unclassified. Please update the proposed section <br />based upon discussions regarding groundwater points of compliance at the Colowyo Mine. <br /> <br />4. On proposed Map 11C, it was observed that Well No. 46212 was removed and is unclear to the <br />Division on why. Please provide the Division additional details on to why Well No. 46212 was <br />removed on the proposed Map 11C. <br /> <br />5. When reviewing Exhibit 7, Hydrology Information – Table of Contents, the Division observed <br />there are some overlaps on the numbering of Items under Exhibit 7, specifically Items 14 and the <br />newly proposed Item 15 – Colowyo Mine Points of Compliance Evaluation.
