Page 4 <br /> Mr. Eric Scott <br /> October 30, 2018 <br /> You must provide information sufficient to demonstrate that the stability of any structures located within two <br /> hundred(200)feet of the operation or affected land will not be adversely affected. <br /> See attached stability analysis included in the original submittal. A memo has also been added to <br /> the stability analysis discussing the change from a 0.5 horizontal to 1 vertical to a shallower mine <br /> slope of 3 horizontal to 1 vertical. In summary the mine highwall location has not changed and the <br /> slopes are safer than mining at a 0.5 horizontal to 1 vertical. The silt storage pond will still be mined <br /> at 0.5 horizontal to 1 vertical as there is adequate backfill (831,000 tons of backfill available)and <br /> remaining silts from the processing of aggregate to fill the silt storage. The silt storage requires <br /> 285,000 tons of backfill. <br /> Additional Information: You will also need to provide the Division with proof of notice publication and notice <br /> to property owners within 200'of the permit boundary. Letters from other commenting agencies/entities <br /> received by the Division to date were provided during the pre-operation inspection for you to review. <br /> See proof of mailing to owners within 200 feet and proof of publication including an email from <br /> Cynthia Fitch (Fort Lupton Press) stating the publication was placed in the paper. <br /> This concludes the Division's preliminary adequacy review of this application. This letter shall not be <br /> construed to mean that there are no other technical deficiencies in your application. Other issues may arise <br /> as additional information is supplied. Please remember that the decision date for this application is October <br /> 15, 2018.As previously mentioned, ifyou are unable to provide satisfactory responses to any inadequacies <br /> prior to this date, it will be your responsibility to request an extension of time to allow for continued review of <br /> this application.
