Page 3 <br /> Mr. Eric Scott <br /> October 30, 2018 <br /> The miner commits to this request. <br /> In the event that trigger levels are exceeded, or complaints of off-site groundwater impacts are received, <br /> please commit to notifying DRMS within 5 working days. The provided notice shall include, at a minimum, a <br /> description of the issue observed or reported(excessive mounding or shadowing off site impact, etc), <br /> additional data to be gathered by the permittee to characterize the issue if needed, and possible corrective <br /> actions that may be implemented to resolve the issue if deemed necessary. <br /> The miner commits to this request. <br /> EXHIBIT L -Reclamation Costs(Rule 6.4.12): <br /> All information necessary to calculate the costs of reclamation must be submitted and broken down into the <br /> various major phases of reclamation. You must provide sufficient information to calculate the cost of <br /> reclamation that would be incurred by the state. <br /> See attached cost/reclamation estimates. Also see the comments under"Mining Plan"above. <br /> DRMS will further evaluate the provided reclamation costs when all other adequacy issues have been <br /> resolved.At this time it appears that, at a minimum, additional information will be required regarding costs to <br /> backfill mined slopes from 0.5H:1 V within all excavated areas, backfill and fully reclaim the sediment pond <br /> and clean water ponds, install engineered inlet/outlet structures for all remaining open water reservoirs, and <br /> provide documentation to substantiate unit costs for slurry wall installation. <br /> See attached cost/reclamation estimate. Included is a justification for the slurry wall cost which has <br /> been updated to$4.30/square-foot. <br /> EXHIBITS-Permanent Man-Made Structures(Rule 6.4.19): <br /> Please note that roadways and above-ground or underground utilities(if present)within 200 feet of the <br /> proposed affected area are considered permanent man-made structures. In accordance with Rule 6.4.19, <br /> when mining operations will adversely affect the stability of any significant, valuable and permanent man- <br /> made structure located within 200 feet of the affected area, the applicant may either: <br /> a)Provide a notarized agreement between the applicant and the person(s)having an interest in the <br /> structure, that the applicant is to provide compensation for any damage to the structure;or <br /> (b) Where such an agreement cannot be reached, the applicant shall provide an appropriate <br /> engineering evaluation that demonstrates that such structure shall not be damaged by activities <br /> occurring at the mining operation;or <br /> (c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br /> letterhead, from the owner(s)of the utility that the mining and reclamation activities, as proposed, <br /> will have "no negative effect"on their utility. <br /> Please provide evidence(such as proof of delivery of certified letter to structure owners)that a notarized <br /> agreement between the structure owners and the applicant was pursued. If an agreement is unable to be <br /> reached a geotechnical assessment may be provided to demonstrate that the structures shall not be <br /> damaged. <br /> See proof of mailing return receipt that the agreement and stability analysis was delivered to all <br /> structure owners. <br />
