(e) On any affected land so long as chemical and physical characteristics of the <br /> surface and immediately underlying materials of such affected land are toxic, <br /> deficient in plant nutrients, or composed of sand, gravel, shall feasibly be <br /> remedied by chemical treatment, fertilization, replacement of overburden, or <br /> like measures. <br /> (9) The operator understands that where adverse characteristics of the surface <br /> exist, and it is not feasible to remedy by artificial measures, that substitute <br /> acres may be reclaimed. <br /> 3.1.11 Buildings and Structures <br /> This site is privately owned surface and minerals is appurtenance to the land, <br /> and does not fall under the State Historic Preservation Office Requirements for <br /> a cultural or history study. <br /> There is a family cemetery onsite that will have a 50-ft no-mining buffer. <br /> Overhead power lines within the site are owned by San Isabel Electric <br /> Association. <br /> County roads provide access to the site. <br /> Structure agreements are included in Exhibit "S" <br /> 3.1.12 Signs & Markers <br /> (1) The operator will post a sign which will be clearly visible from the access <br /> road with the following information addressed: <br /> (a) The name of the operator; <br /> (b) A statement that a reclamation permit for the operation has been <br /> issued by the Colorado Mined Land Reclamation Board; and <br /> (c) the permit number. <br /> (2) The boundaries of the affected area will be marked with monuments, that <br /> are clearly visible: <br /> (a) This is a 112 operation, therefore, the permit boundary and the <br /> affected boundary are not the same, and the operator/applicant is proposing a <br /> floating bond to cover a portion of the site, to allow mining and reclamation to <br /> be ongoing. <br /> (3) The affected land will be monumented for easy delineation. <br /> End of requirements of Section 3.1 Reclamation Performance Standards. <br />
