All reasonable <br /> expenses of storage,packing,shipping,delivery and insurance,or of sale,shall be paid as an expense <br /> of administration. <br /> 3. 1 give my Romeo Sand&Gravel Pit business to my daughter,Gale T.Swafford,being the <br /> 65 acres more or less, in the Northeast quarter of the Southwest quarter 28-34-9 N.M.P.M., County <br /> of Conejos, State of Colorado,including,but not limited to all related improvements to the property, <br /> equipment and bank accounts related to that business.I also give to Gale Swafford any funds that are <br /> left in my other bank accounts after the payment of all of the expenses of my estate. <br /> 4. I give my residuary estate to my children in equal shares. If any child predeceases me, I <br /> give his/her share of my Estate to issue of said deceased child per stirpes. If the deceased child has <br /> no issue, his/her share shall lapse and be divided equally among my surviving children. <br /> D. I make, constitute and appoint the following persons in the following order as special <br /> administrator and Personal Representative to serve in any capacity without bond: <br /> 1. I give and grant unto my Special Administrator and Personal Representative,full power <br /> and lawful authority to manage, operate,lease, sell,retain,exchange,mortgage,pledge or otherwise <br /> encumber or dispose of all or any part of my Estate and property, publicly or privately, in such <br /> manner and at such times and on such terms as such fiduciary shall deem expedient and <br /> advantageous without obtaining any order of the Court therefore,and without restrictions as to legal <br /> or statutory investment,irrespective of any constitution, statutes, or Court decisions with respect to <br /> Estate or trust investments. Particularly,but without limitation of other powers,I give said fiduciary <br /> full power to continue the operation of any or all businesses which I may have at the time of my <br /> death, alone or in conjunction with other persons, as such fiduciary shall deem expedient. <br /> My Special Administrator,Personal Representative,and other fiduciary in any capacitymay <br /> also execute such joint tax returns and pay such taxes or interest and deal with any tax refunds, <br /> interest or credits, as he shall deem necessary or advisable, either in the interest of the other joint <br /> taxpayer or in the interest of my Estate. <br /> F. I direct that my Estate be administered without Court supervision and under the informal <br /> probate and appointment proceedings of the Colorado Probate Code, unless the Court shall order <br /> formal probate upon petition and notice at any time during the period of administration.
