The application was deemed complete on
September 27, 2018. TR -85 is proposing to reduce the permit boundary by 285.94 acres and revise the
Pond 15 design. The Division finished its review of the TR -85 application has the following adequacy
questions or comments.
In Section 2.03 page 8, it lists under "Other mining operations..." the New Horizon Mine. Since
this page is for the New Horizon Mine permit, the other mine that should be listed is the New
Horizon North Mine. Please correct this typo.
2. In Section 2.03 pages 11-12, the list of contiguous owners needs to be corrected. Richards (9),
GW46 (13), Goforth (15) and Slash M (43) are not considered contiguous land owners. They are
surface owners listed in Section 2.03.4(6)(a). Moore (18), Higgs (27) and Massini (24) are
contiguous land owners that need to be added to the list.
3. In Section 2.03 pages 11-12, Raymond Davis needs to be added to the list of contiguous land
owners. The Davis property is located adjacent to where the Lincoln Haul Road meets Lincoln
Street.
4. In Section 2.03 page 12, the list of oil, gas and minerals ownership is missing Benson (41) as
owners that need to be added.
5. On Map 2.03.4-1— Surface Ownership and Leases, the adjacent landowner north of Parcel 9
needs to be labeled.
6. In Section 2.04.3, the top of page 5 states that 286.79 acres are being removed from the permit
area. This number is consistent with the cover letter submitted with the application but is
6y q0t8,,
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining. state. co. us
John W.
